Board of Appeals Robert K. Kraft - SP-97-20 2. <br /> FINDINGS <br /> A. General <br /> 1. the subject property is located at 16 Popponesset Island Road and contains <br /> 41,500 square feet fronting on Popponesset Bay. <br /> 2. the immediate neighborhood consists of single family homes many of which <br /> have been improved with additions and/or reconstruction. <br /> 3. two non-conforming residential structures are currently on the site and will be <br /> replaced with a single residential structure. <br /> B. Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws and Mass. General Law Chapter <br /> 40A, Section 6, require a finding that the extension, alteration or change shall not be <br /> substantially more detrimental to the neighborhood than the existing non-conforming use. <br /> C. Specific Findings <br /> 1. the proposed changes between the existing dwellings and the proposed <br /> construction will not increase the non-conforming nature of the structure. <br /> 2. the new structure will conform to present front, rear and sideline setback <br /> requirements, and will be constructed no closer to the coastal bank than the <br /> existing structures. <br /> 3, the new structure, including attached decks, will result in lot coverage of <br /> 10.2% which is below the 20% permitted under the By-laws. <br /> 4. the site conditions will be improved with the removal of an existing cesspool <br /> and the replacement with a Title V denitrification septic system. <br />
