Board of Appeals Mashpee Industrial Park TR. - Telecommunications Tower 5. <br /> 8. The Mashpee Industrial Park Trust shall be responsible to insure that the Facility is <br /> maintained in good condition. Such maintenance shall include, but shall not be <br /> limited to, painting, structural integrity of the mount and security barrier, and <br /> maintenance of the buffer areas and landscaping. <br /> 9. At such time that the Mashpee Industrial Park Trust plans to abandon or <br /> discontinue operation of the Facility, it will notify the Town by certified U.S. mail <br /> r of the proposed date of abandonment or discontinuation of operations. Such <br /> notice shall be given no less than 30 days prior to abandonment or discontinuation <br /> of operations. <br /> 10. Upon abandonment or discontinuation of use of the Facility,the Mashpee <br /> Industrial Park Trust shall physically remove the Facility within 90 days from the <br /> date of abandonment or discontinuation of use. "Physically remove" shall include, <br /> but not be limited to: <br /> -removal of antennas, mount, equipment shelters and security barriers from <br /> the subject property <br /> -proper disposal of the waste materials from the site in accordance with <br /> local and state solid waste disposal regulations <br /> -restoring the location of the personal wireless service facility to its natural <br /> conditions, except that any landscaping and grading shall remain in the after <br /> condition. <br /> 11. If the Mashpee Industrial Park Trust fails to remove the Facility, the Town shall <br /> after written notice at least 30 days prior to such action, have the authority to enter <br /> the subject property and physically remove the facility. The Mashpee Industrial <br /> Park Trust shall be required to post a $10,000 bond for fifteen (15)years at the <br /> time of construction to cover costs for the removal of the Facility in the event the <br /> Town must remove the facility. <br />
