This action is a zoning appeal pursuant to Massachusetts <br /> General Laws Chapter 40A, Section 17. <br /> FACTS <br /> 8. The Defendants Charles F. Doe, Jr. , Dana G. Doe and William A. <br /> Doe, as Trustees of the Doe Family Trust II are, upon <br /> information and belief, the owners of the property situated at <br /> the corner of Ryan's Way and Great Neck Road North. The <br /> property is located in a C-1 Zoning District, with a street <br /> address of 8 Ryan's Way and is shown on Mashpee Assessor's Map <br /> 67 as Block 75 (hereinafter "Property") . <br /> 9. The Plaintiffs are the owners of the premises abutting the <br /> Defendant's Property on the south and shown on Mashpee <br /> Assessors Map 74 as Block 22. <br /> 10. The Defendants applied to the Mashpee Zoning Board of Appeals <br /> for a special permit and a variance from and under Sections <br /> 174-55 B, C, F, and G of the Mashpee Zoning Bylaw for <br /> permission to allow internal illumination of a sign, to exceed <br /> the maximum signboard area and to locate a freestanding sign <br /> twelve (12) feet from the Property lot line on Great Neck Road <br /> North. <br /> 2 <br />
