Comments were received from the Director of Public Works <br /> q <br /> recommending improvements to the internal circulation of traffic on the site and revised <br /> site plans were presented to the Board at the May 8, 1996 meeting incorporating these <br /> recommendations. <br /> The Board was informed that a curb cut application has been filed with Mass. <br /> Highway, owing to the new structure. <br /> Variance Criteria: Section 10 of Chapter 40A requires that the permit granting <br /> authority determine that there are circumstances relating to the shape and topography <br /> which affect the subject lot and not the district in which it is located and that a literal <br /> enforcement of the by-laws would involve hardship to the petitioner and that relief may be <br /> granted without detriment to the public good and without derogating from the intent or <br /> purpose of the By-laws. <br /> FINDINGS <br /> A. General <br /> 1. The property is an approximately 55,000 square foot triangular shaped lot with <br /> 301 feet of frontage on Falmouth Road/Route 28 and approximately 46 feet of <br /> frontage on Great Neck Road. The lot is within the commercial zoning <br /> v <br /> district. <br /> 2. The property has been used for a gasoline sales and automotive repair service <br /> a <br /> station since 1967. <br /> 3. In 1995 this site was granted a Special Permit and Variance to allow the <br /> a construction of a canopy and commencement of convenience store operations. <br /> At this time substantial landscaping and highway improvements were made to <br /> the area. <br /> 4. The existing and proposed structures on the lot do not conform to the current <br /> v Zoning By-laws insofar as they encroach upon existing setback requirements. <br /> 0 <br /> 0 <br />
