Board of Appeals Edward Siegfried - SP-96-72 2. <br /> FINDINGS <br /> A. General <br /> 1. the subject property is located at 220 Wading Place Road and contains 22,796 <br /> square feet. <br /> 2. the neighborhood consists of single family homes many of which have been <br /> improved with additions or reconstruction. <br /> 3. the existing structure on the property was built before zoning in Mashpee and <br /> is a pre-existing non-conforming building. <br /> B. Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws and Mass. General Law Chapter <br /> 40A, Section 6 require a finding that the extension, alteration or change shall not be <br /> substantially more detrimental to the neighborhood than the existing non-conforming use. <br /> C. Specific Findings <br /> 1. the proposed changes between the existing dwelling and the proposed <br /> construction will not increase the non-conforming nature of the structure. <br /> 2. the proposed dwelling will be an improvement to the site conditions since there <br /> will be increases in the front and rear setbacks and the side setbacks will <br /> conform with present zoning. <br /> 3. the proposed reconstruction will conform to the height requirements of the <br /> Popponesset Overlay District. <br /> 4. the proposed lot coverage of approximately 17.9%will be less than the 20% <br /> allowed by the Zoning By-laws. <br /> 5. the proposed reconstruction will permit substantial improvement to the existing <br /> site conditions by conforming with Flood Plain Construction requirements. <br /> 6. the site conditions will be further improved with the removal of the subsurface <br /> cesspool system and replacement with a new Title V denitrification system <br /> which will be located at the front of the dwelling, increasing its distance from <br /> wetland resource areas. <br />
