Board of Appeals Minutes - January 11, 1995 2. <br />• James Warner - Requests a Special Permit under Sections 174-17 and 174-20 of the <br />Zoning By-laws for permission to relocate an existing cottage and to relocate and <br />reconstruct a house damaged by fire on property located in an R-3 zoning district at 71 <br />Seconsett Island Road (Map 119, Block 104) Mashpee, MA. (Owner of record: Ruth A. <br />and James A. Warner Jr. TRS.) <br />Members sitting: E. Govoni, J. Regan, C. Hawver <br />Mr. Govoni read a letter from Douglas Levings, representing Mr. Warner, requesting that <br />the Board approve a withdrawal of the application without prejudice. <br />Mr. Govoni moved to grant the withdrawal without prejudice. Mr. Regan seconded. All <br />agreed. <br />Ronald J. Kurker - Requests a Variance from Section 174-32 of the Zoning By-laws to <br />allow the construction of a home on an unpaved road on property located in an R-3 <br />zoning district at 48 Blue Castle Drive (Map 104, Block 13) Mashpee, MA. (Owner of <br />record: John G. Bynoe). <br />Members present: E. Govoni, J. Regan, K. Marsters, R. Nelson, C. Hawver <br />. Mr. Govoni read correspondence from the Fire Chief and made it part of the record. <br />Ed Montero represented the applicant and explained that the Chief's request to install a <br />sprinkler system in the proposed house would cause substantial financial hardship for the <br />prospective buyer. Mr. Govoni noted that the Building Inspector had stated that the <br />Board of Appeals had no authority to condition anything on the inside of a house. The <br />Board was informed that five houses exist on the street. Mr. Nelson asked that the Board <br />get an accurate definition of"all weather surface". Mr. Govoni moved to take the <br />application under advisement and to review it with the Fire Chief. Mr. Marsters seconded. <br />All agreed. <br />Daniel J. Donahue - Requests a Variance from Section 174-31 of the Zoning By-laws to <br />vary the frontage and setback requirements of footnotes 2,6,8, 13 and 14 for commercial <br />property located on Route 151 at 428 Nathan Ellis Highway (Map 72, Block 86) <br />Mashpee, MA. (Owner of record: Eugene E. Labute). <br />Daniel J. Donahue_:_ Requests a Special Permit under Sections 174-17, 174-21, 174- <br />25.E.8, 174-25.F.5, 174-25.G.9, 174-25.H.6 and 174-82 of the Zoning By-laws for <br />permission to construct an additional building on a non -conforming commercial lot. The <br />applicant proposes to continue the present use of the premises for contractor's storage and <br />repair and add a retail/wholesale garden supply business in the proposed building. The site <br />is located on Route 151 in a C-2 zoning district at 428 Nathan Ellis Highway (Map 72, <br />Block 86) Mashpee, MA. (Owner of record: Eugene E. Labute). <br />C1 <br />J <br />
