Board of Appeals Minutes - March 22, 1995 3. <br />• the rotary into the southbound lane of Route 28 . Mr. Nelson stated that the station has <br />not been in continuous operation and Mr. Govoni said it was not a problem because it had <br />not been out of business for two years. Mr. Nelson questioned if Mobil would have two <br />stations in Mashpee and Mr. Quigley responded that this station is owned by Mobil and <br />the other on Route 28 is not and may be changed. <br />Mr. Govoni questioned if the canopy is a structure and Mr. Murphy said he believed it was <br />a structure and that it was covered under the Variance application on setbacks under 174- <br />31. Mr. Govoni reviewed correspondence from the Fire Dept. regarding property <br />transfer. Mr. Quigley said the information has been submitted to the Fire Dept. and that <br />Selectmen have O.K.'d the tanks. Mr. Govoni asked about the curb cut permit from state <br />DPW and Mr. Quigley said they will have it the week of 3/27/95. Mr. Govoni said that <br />an additional parking space was needed and that Mobil must meet all requirements of the <br />Board of Health. Mr. Murphy explained that Geological Services Inc., the environmental <br />company, has retracted their statement to the Board of Health and now declared that the <br />site is clean. Mr. Govoni said that Mobil will have to post a bond for landscaping. Mr. <br />Quigley said it was $6,800 for landscaping on their property <br />John Renz of Fields Point, an abutter, asked if Design Review had approved plans. Mr. <br />Quigley said they had approval except for the sign on Great Neck Road South. Mr. Renz <br />asked for percentage of expected sales for gas and convenience store and Mr. Quigley <br />said 80% would be gas and 20% gas and food. He asked if the Cape Cod Commission was <br />• reviewing the plan and Mr. Govoni said it was outside of their threshold. Mr. Nelson <br />asked for total landscape costs and Mr. Quigley said that they will be donating $3,000 - <br />$5,000 to the Mashpee Beautification Council and they will get the permit to extend the <br />island. Mr. Quigley also said all lighting will be direct downhght. Mr. Marsters asked if <br />they proposed selling liquor and Mr. Murphy said they did not. He also asked how the <br />canopy would compare with Shell and Mr. Quigley said theirs would be the same size. <br />Mr. Govoni moved to grant the Variance from Sections 174-30, 174-31, 174-55 and 174- <br />3 to eliminate the 20' setback between buildings (the building proper and the proposed <br />canopy), to vary the front setback for the canopy by 71.58' and allow a front setback of <br />3.42 feet; to vary the side setback by 8.06' and allow a side setback of 12.94 feet. Mr. <br />Govoni noted that the Variance was based on the topography and shape of the lot and was <br />referenced by Plans of Eastern Consulting Inc. Revision 8 of Plan SS# 01-B3T. Mr. <br />Govoni also moved to grant a Variance from Section 174-55 to allow a free standing sign <br />of 55.1 square feet per Revision 5 of the plans dated 3/17/95. Mr. Nelson seconded. All <br />agreed. <br />Mr. Govoni moved to grant the Special Permit under Sections 174-17, 174-22, 174- <br />24.A.4, 174-24.C, 174-25.E.1, 174-25.F.1, 174-51 and 174-55 to allow the expansion of <br />a pre-existing non -conforming gasoline station and to eliminate automotive repair, to <br />renovate and expand the station to include a convenience store, to construct a canopy <br />over proposed new gasoline dispensing pump islands; remove two existing streetfront <br />signs and install one new streetfront "Mobil" sign on Falmouth Road and erection of <br />
