Board of Appeals Mobil Oil Corporation V-95-27 2. <br /> Attorney I D. Murphy and Engineer Frank Quigley represented the applicant. <br /> Attorney Murphy reviewed plans for the change of an existing gasoline service and repair <br /> station to a station for gasoline sales and a convenience store. The applicant proposes to <br /> add a canopy over new gasoline pumps which will require a Variance of the 20 foot <br /> setback between buildings and in the front setback; an addition to the existing building <br /> which will require a Variance in the side-line setback; and a Variance to exceed the <br /> allowed 40 foot square footage in a free standing sign. The Board was informed that the <br /> applicant has approval from the Selectmen for the installation of three new gasoline <br /> storage tanks and from the Board of Health for a new septic system and will be connecting <br /> to Town water. The applicant has the approval of the State Highway Department and the <br /> Mashpee Department of Pubfic Works to extend the island which runs down the center <br /> line of Falmouth Road from the Rotary Circle to approximately the center of the frontage <br /> of the premises and to add a sign at the northerly driveway to bar exiting traffic from <br /> making a left turn. <br /> Variance Criteria: Section 10 of Chapter 40A requires that the permit granting <br /> authority determine that there are circumstances relating to the shape and topography <br /> which affect the subject lot and not the district in which it is located and that a literal <br /> enforcement of the by-laws would involve hardship to the petitioner and that relief may be <br /> granted without detriment to the public good and without derogating from the intent or <br /> purpose of the By-laws. <br /> Findings: <br /> A. General <br /> 1. The property is an approximately 55,000 square foot triangular shaped <br /> lot with 301 feet of frontage on Falmouth Road/Route 28 and <br /> approximately 46 feet of frontage on Great Neck Road. The lot is <br /> within the commercial zoning district. <br /> I <br />
