MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT <br />Petitioner, Jon Hagenstein, Beacon Marine Construction, LLC <br />Owner of Record: Crown Atlantic Company LLC <br />43 Bowdoin Road (Map 62 Parcel 79) <br />Mashpee, MA 02649 <br />SP-2021-64 <br />Mr. Furbush discussed the Special Permit definition and requirements as listed in the Town <br />bylaws under § 174-25, specifically Section C. He asked the applicant to discuss the ground <br />water protection of the property. <br />Raul said that the lot is not located in a ground water protection district. The westerly <br />property line is the boundary of the ground water protection district. There will be a ground <br />water drainage system installed. The second sheet of the site plan shows the details that <br />were updated as requested at the Plan Review meeting. The proposal includes to control <br />water runoff. The runoff produced will travel over the gravel surface that is not impervious, <br />and will be slopping toward the south. A grass basin will be installed to provide retention <br />of any water runoff before running under ground to the subsurface leaching field. There's <br />no septic system required because there is no wastewater or nitrogen involved. <br />SPECIAL PERMIT FINDINGS <br />The Plan Review Committee recommended the following for the Zoning Board of Appeals <br />decision; <br />• The 48 ft. contour be revised per the Town Engineer's comments. <br />• The shared driveway shall be paved per the plan. <br />• The improved parking area will be crushed stone. <br />• The shared driveway will be paved, and that there be a condition of approval to <br />require proper access to be provided to the property at 43 Bowdoin prior to the sale <br />of the property to alleviate the shared driveway. <br />The Board read the comments submitted by Catherine Laurent, DPW Director into the <br />record. "For 43 Bowdoin Road, it is unclear from the plan what is proposed for drainage. <br />All storm water runoff shall be contained onsite. In addition, there is not currently drainage <br />infrastructure at the existing entrance for 37 Bowdoin Road and storm water is running off <br />into the road. With the proposed shared entrance, drainage should be installed. Finally, <br />overflow parking (stone) was installed for 37 Bowdoin Road without any permits. This <br />overflow parking should be eliminated with the addition of the contractor area at 43 <br />Bowdoin Road." <br />Chris Gallagher, Town Engineer said he discussed his concerns and is satisfied. <br />Raul said that a fence will be installed and will be connected on the West side, and will be <br />along the side of the boat yard and towards the East connecting with the existing fence <br />surrounding the cell tower. There will be a driveway installed with a fence to provide <br />privacy for the yard. The fence will separate the uses for the tower and the yard. <br />2 <br />
