Board of Appeals Minutes - January 13, 1993 2. • Members sitting: J. Friel, M. Makunas, E. GOvoni Engineer John Slavinsky represented the applicants and presented plans for a proposed house addition and deck. He explained that the house addition conformed to zoning but that the deck required a variance since it was only 45' from Hamblin Pond and 12.1' from the lot line. He explained that the topography and shape of the lot caused a hardship• There was discussion on whether a variance was needed on the side line since the deck was placed further back. Mr. Makunas moved to grant a Variance of 5' on the North allowing a 45' setback from Hamblin Pond and a Variance of 2.9' on the Northeast side and 6.7' on the Southeast. Mr. Govoni seconded. All agreed. Mr. Makunas said they were not encroaching on the sideline. He asked that this issue be noted for discussion with Town Counsel. Mr. Govoni moved to grant the Special Permit. Mr. Makunas seconded. All agreed. Fields Point - Hardware Store Mr. Makunas moved to accept the request for a 90 -day • extension in the application for a Special Permit for the hardware store to allow approval of new plans by the Design Review committee. The extension will be to April 13, 1993. Mr. Friel seconded. All agreed. Robert DeLory, a member of the audience, asked i1 this was to be voted by the Cape Cod Commission and Mr. Friel said the hardware store was not before the Commission. Fields Point Limited Partnership - Request a variance from Sections 174-31 and 174-38 of the zoning By-laws for permission to vary the setbacks to an internal driveway and to vary the size and dimension of parking spaces in a C-1 zoning district on property located at 39 Nathan Ellis Highway (Map 74, Block 22) Mashpee, MA. Members sitting: J. Friel, M. Makunas, E. Govoni Mr. Friel moved to open the hearing since applicants were not present. He noted there were variations in the plans submitted in August and December and invited members of the audience to review them. Selectman Nancy Calfyn asked where the Town bikeway would be located. Greg Taylor, DPW director, questioned the back setbacks. Mr. Friel and Mr. Govoni stated that the plans were lacking detailed dimensions. There was discussion that the plan represented ., 12.2 acres of the 15 acre site. Mr. Storrs arrived at the hearing to represent Fields Point. He explained that the line o1 the plan was not a property line but had been a line agreed to with the Cape Cod Commission.
