GOvoni <br />Engineer John Slavinsky represented the applicants and <br />presented plans for a proposed house addition and deck. He <br />explained that the house addition conformed to zoning but <br />that the deck required a variance since it was only 45' from <br />Hamblin Pond and 12.1' from the lot line. He explained that <br />the topography and shape of the lot caused a hardship• There <br />was discussion on whether a variance was needed on the side <br />line since the deck was placed further back. <br />Mr. Makunas moved to grant a Variance of 5' on the North <br />allowing a 45' setback from Hamblin Pond and a Variance of <br />2.9' on the Northeast side and 6.7' on the Southeast. Mr. <br />Govoni seconded. All agreed. Mr. Makunas said they were not <br />encroaching on the sideline. He asked that this issue be <br />noted for discussion with Town Counsel. <br />Mr. Govoni moved to grant the Special Permit. Mr. <br />Makunas seconded. All agreed. <br />Fields Point - Hardware Store <br />Mr. Makunas moved to accept the request for a 90 -day <br />• extension in the application for a Special Permit for the <br />hardware store to allow approval of new plans by the Design <br />Review committee. The extension will be to April 13, 1993. <br />Mr. Friel seconded. All agreed. <br />Robert DeLory, a member of the audience, asked i1 this <br />was to be voted by the Cape Cod Commission and Mr. Friel said <br />the hardware store was not before the Commission. <br />Fields Point Limited Partnership - Request a variance <br />from Sections 174-31 and 174-38 of the zoning By-laws for <br />permission to vary the setbacks to an internal driveway and <br />to vary the size and dimension of parking spaces in a C-1 <br />zoning district on property located at 39 Nathan Ellis <br />Highway (Map 74, Block 22) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Mr. Friel moved to open the hearing since applicants <br />were not present. He noted there were variations in the <br />plans submitted in August and December and invited members of <br />the audience to review them. Selectman Nancy Calfyn asked <br />where the Town bikeway would be located. Greg Taylor, DPW <br />director, questioned the back setbacks. Mr. Friel and Mr. <br />Govoni stated that the plans were lacking detailed <br />dimensions. There was discussion that the plan represented <br />., 12.2 acres of the 15 acre site. Mr. Storrs arrived at the <br />hearing to represent Fields Point. He explained that the <br />line o1 the plan was not a property line but had been a line <br />agreed to with the Cape Cod Commission. <br />
