el <br />• had found the Starboard Lane property last fall and before <br />purchasing had investigated how it could be upgraded to a larger <br />size to meet her family's needs. She said they had their builder <br />investigate Board of Health requirements and her husband met <br />with the Building Inspector in October and everything seemed <br />favorable and they purchased in November. She explained that <br />they chose an architect and explained to him that they wanted <br />a house that would be appropriate to the neighborhood and would <br />be a benefit to the area. <br />Mr. Crescenzi explained that he worked with the architect, <br />engineers, Conservation Commission and Board of Health and <br />decided to re -do the entire septic system. He said the final <br />house plans were completed in April and new septic system and <br />site plans were completed. His builder was issued the Building <br />Permit and the Demolition Permit on May 12 and May 13. Work <br />began a week later and on June 11 his builder notified him that <br />the Building Inspector had asked him to stop work for a couple <br />of days. All of the lumber for the framing had been delivered <br />to the site and Mr. Crescenzi said he had a conversation with <br />the Building Inspector and was told he might have to issue <br />a Stop Work order and that a Special Permit might be required. <br />Mr. Crescenzi said they decided to stop the project and arranged <br />for the return of the lumber and delayed the delivery of windows <br />and other items. He explained that quite a bit of money had <br />been committed to the project at this time. He said they <br />• received the Stop Work letter from Mr. Hauck on June 17. <br />Attorney Ford explained that the foundation was in and he stated <br />that he believed the Board had the authority under Chapter 40A, <br />Section 6 and 174-17 to make a finding that the proposed <br />structure is no more detrimental to the neighborhood than the <br />existing structure was. He said there was one change in setbacks <br />that is closer to one side line than the previous foundation. <br />The house was moved closer at the recommendation of Town <br />officials because of the identification of a coastal bank and <br />it was suggested by the Conservation Commission, Board of Health <br />and Building Department that the house should be drawn farther <br />back. He said the footprint is similar and that this is a two- <br />story structure replacing a single story structure. He said <br />the new septic system is designed for the new house. He asked <br />the Board to find that this is not substantially more detrimental <br />to the neighborhood than the pre-existing structure and recognize <br />the difficult position the owners have been put in in their <br />efforts to follow everything they were told to do by Town <br />officials. <br />Mr. Govoni asked if there was to be a deck on the house and <br />Mr. Crescenzi explained there would be ground level deck. Mr. <br />Makunas asked if there were any other encroachments which did <br />not show on the certified foundation plan and Mr. Ford replied <br />• that the only one that came closer than permitted is the side <br />yard which he explained. Mr. Govoni asked Mr. Hauck if the <br />front setback was 40'and Mr. Hauck stated the present zoning <br />
