5. <br />• house is complying because of the average of the setbacks. <br />Ms. Stefos questioned the current 40' setback and Mr. Ford <br />explained the footnote A6. Mr. Ford said they did everything <br />they thought they should do -- they went to the Building <br />Inspector before they bought it, went to the Building Inspector <br />after they bought it, had the architect go to the Building <br />Inspector and that notices are not given before getting a <br />Building Permit. <br />Jeff Willis, a builder, asked if there were any laws about <br />blocking other peoples views. Mr. Hauck said there were no <br />laws. <br />Ms. Stefos asked why the new drawing was not measuring from <br />the deck and Mr. Makunas explained that it was a foundation <br />drawing and the previous drawing was an as -built. Mr. Makunas <br />said they had resolved the new deck and the actual setback from <br />the road. Mr. Mindick said it does comply. <br />Ms. Stefos said the houses would be hovering over hers and was <br />detrmimental because of the size not only for the view. <br />Mr. Mindick moved to take it under advisement. Mr. Govoni <br />seconded. All agreed. <br />Mr. Ford asked if it was possible that the Board would vote <br />• later in the evening and Mr. Makunas replied it was possible <br />but they had a long agenda. Mr. Ford asked when would be the <br />next time and Mr. Makunas said the next meeting which would <br />be August 11. Mr. Makunas said he would urge the Board to discuss <br />expediting this. Mr. Ford said they were in this position through <br />no fault of their own and it is a very difficult position to <br />be in. <br />Sandra A. Ellis.- Requests a Special Permit under Section 174- <br />25.A.8 to allow an in-law apartment in an R-3 zoning district <br />on property located at 34 Rainbow Lane (Map 69, Block 36F) <br />Mashpee, MA. (Owner of record: Norman L. McDonald and Sandra <br />A. Ellis)'. <br />Members sitting: J. Friel, M. Makunas, J. Regan <br />Ms. Ellis explained that a second kitchen had been added to <br />her home so that she and her father had an upstairs apartment <br />and her daughter and family lived on the first floor. She said <br />she had been refinancing and the Bank said a Special Permit <br />was required. She said, however, she had received the financing. <br />Mr. Friel asked if they ever expected to rent and she said no. <br />Mr. Makunas said that since she received the loan he would <br />suggest a withdrawal. Ms. Ellis signed a request for withdrawal. <br />• Mr. Makunas moved to request a withdrawal without prejudice. <br />Mr. Friel seconded. All agreed. <br />
