Public Comments: <br /> Marie Scallie - stated that she supports this article. she <br /> has attended many ZBA hearings and sat through dock hearings <br /> and Paul Somerville has given his professional opinion and <br /> Lisa Hanscom has given her opinion and she has seen these <br /> opinions be ignored therefore she can see why this article <br /> is here. she supports no variance in this instance. <br /> Judy made a motion to recommend article 3 as written. Pat <br /> seconded the motion. Tony was opposed (would like to see a <br /> 1 year time limit) and Louise abstained. <br /> ARTICLE 4 <br /> It was submitted by the Zoning Board of Appeals . <br /> Mike McKoanis left the meeting at this time and Cheryl <br /> Hauvar stated that Rich would now represent the ZBA. <br /> He explained that this is bringing the non conforming by law <br /> up to the State statue which was passed by the legislature <br /> in 1987 . <br /> Tom asked if it is necessary since the State statue already <br /> says it? <br /> Rich stated that this makes it clearer. He took this from <br /> the Falmouth by law. <br /> Tony stated that there is a big difference in the last <br /> sentence. The state is giving the right not to have the <br /> building torn down but is not giving cart blanch to expand or <br /> modify it. <br /> Rich stated that this by law would allow people to improve <br /> their property. <br /> Tony stated that the state allows you to maintain property. <br /> The state statue also deals with use, the by law only <br /> creates a non conforming structure. <br /> Tony explained that they will need to discuss this with Town <br /> Counsel before recommending this article. <br /> Pat asked Rich if the Board of Appeals discussed this <br /> article? <br /> He replied that it is based on the Falmouth by law. <br /> Louise made a motion to defer decision until further input <br /> from Town Counsel . Pat seconded the motion. All members <br /> were in favor. <br /> Louise made a motion to close the public hearing. Pat <br /> seconded the motion. All Board members were in favor. <br /> ARTICLE 7 . <br /> Tom explained that it gets rid of the local grandfathering <br /> and follows the state statue. <br /> He will have to add "except for subsections L & G'} . He will <br /> discuss with Town Counsel to make sure that is allowed. <br /> There were no public questions or comments . <br /> ARTICLE 8 <br /> Tom stated that it provides for enforcement of the water <br /> quality monitoring program, it is clarifying what the Board <br /> has been doing. It is a clear by law. <br />
