MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner, D. Brady Rodgers <br /> 18 Mercantile Way(Map 88 Parcel 104) <br /> Mashpee, MA 02649 <br /> SP-2022-24 <br /> The Petitioner, Capewide Construction, is seeking a Special Permit for the uses including a <br /> contractor bay under Section 174-25 (G) (14), and a contractor yard under Section 174-25 (G) <br /> (13). The proposed use will be for a landscape business called Big Guy Landscape, LLC. <br /> Attorney Kirrane said that the Petitioner is also seeking permission from the Board for the office <br /> spaces, and suggests that this is an accessory use to the principal building in the Light Overlay <br /> District. This request is consistent with other uses in the Industrial District that have been <br /> approved by the Board in the past, and will not cause any additional concerns to neighboring <br /> properties regarding traffic,excessive noise,or congestion.The proposed use was approved with <br /> recommendations at the Design Review and Plan Review Committee Meetings, and the Board <br /> of Health submitted comments with their approval. <br /> GENERAL CRITERIA <br /> I <br /> The subject property located at 18 Mercantile Way is approximately 74,476 sq. ft. square feet. <br /> There were no abutters present. <br /> SPECIAL PERMIT FINDINGS <br /> The building will be tan with shutters on the windows as indicated at the Design Review meeting. <br /> There will be wall pack lighting, and a photometric plan will be submitted with the building <br /> permit. There will be fire separation between each bay. <br /> The landscape plan detailed a large amount of vegetative grass along the front area of the <br /> building,with natural trees to help maintain the natural buffer of the front along Mercantile Way. <br /> There will be supplemental plants as recommended by the Design Review Committee.There will <br /> be some grading in the front to help with the storm water retention area so it will not turn into a <br /> pond. The green area on the plan will be grass lined, and mowed annually during the fall about 4 <br /> inches high. The work area does fall under the definition of a rain garden, but there will be an <br /> erosion control with a retention basin mix of wild flowers and grass. The dumpster containers <br /> will be in the rear corner of the lot, and will be surrounded with a 6 ft. fence. <br /> There will be a minimal amount of mulch and fertilizers stored onsite. The hours of operation <br /> will be 7:00 am to 5:00 pm, Monday through Friday. <br /> A storm water drainage plan was submitted,and floor drains will be installed with a tight tank. <br /> The Plan Review Committee submitted comments dated May 3, 2022 and were read into the <br /> record with the following recommendations; <br /> 2 <br />
