MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 8, 2022 <br /> 18 Mercantile Wa Owner, D. Brady Rodgers requests a Special Permit under §174-25 (G) <br /> (13) Contractor Yard, and§174-25 (G) (14) Contractor Bay of the Zoning Bylaws to allow for <br /> construction of a 5,520 sq. ft. warehouse with offices for a landscape business on property <br /> located in the I1 and Light Industrial Overlay District(s), Map 88 Parcel 104, Mashpee, MA. <br /> Attorney Christopher Kirrane represented the owner and applicant. Also present was Dan Ojala <br /> with Down Cape Engineer, Joao Junqueira and Roger Brooks with Capewide Construction. The <br /> proposal includes a 5,520 sq. ft. metal warehouse style building located in the 1-1 Zoning and <br /> Light Industrial Overlay Districts. The property consists of 74,476 sq. ft., and has some 534 ft. <br /> of frontage along Mercantile Way and Commercial St. The proposed meets all the required <br /> dimensional setbacks given that there is 500 plus feet of frontage, over 75 ft. from Mercantile <br /> Way and 75 ft. from Commercial St., over 157 ft. from the easterly sideline and 68.6' from the <br /> northerly sideline. The lot coverage is 7.4% which meets the 25% requirement, and the height <br /> limitation of 35 ft. There will be 16 parking spaces provided,including one handicap space which <br /> exceeds the 12 required amount of parking spaces. <br /> The Petitioner is seeking a Special Permit for the uses including a contractor bay under Section <br /> 174-25 (G) (14), and contractor yard under Section 174-25 (G) (13). The proposed use will be a <br /> landscape business. There will be a small amount of material stored outside for the landscape <br /> business to necessitate the contractor's yard request. <br /> Attorney Kirrane said that the Petitioner is also seeking permission from the Board for the office <br /> spaces and suggests that this is an accessory use to the principal building in the Light Overlay <br /> District. This request is consistent with other uses in the Industrial District that have been <br /> approved by the Board in the past, and will not cause any additional concerns regarding traffic, <br /> excessive noise, and congestion on neighboring properties. The proposed was approved with <br /> recommendations at the Design Review and Plan Review Committee Meetings, and the Board <br /> of Health has submitted comments with their approval. <br /> Chairman Furbush recommended shutters be installed on the building windows as mentioned at <br /> the Design Review meeting. He asked what will be provided for lights on the building. Mr. <br /> Brooks said that it will be the same wall pack lighting as the other buildings, and he can submit <br /> the photometric plan with the building permit. <br /> Mr.Furbush asked about the screening on the lot,and from the neighboring properties. Dan Oj ala <br /> explained that the screening will be provided along Commercial St. There will be a large amount <br /> of vegetative buffer along the front area of the building. The containers will be in the rear of the <br /> lot, and there will be several natural trees to help buffer the front along Mercantile Way. There <br /> will be supplemental plants as recommended by the Design Review Committee. The owner is a <br /> landscaper and will keep the area looking nice. <br /> 5 <br />
