Tony stated that if the intended us of the turnaround was for a <br /> parking area for parcel A it is not a permitted use in an R <br /> district. <br /> Mr. Fitch reiterated that the Board would- like to see the <br /> transition controlled by the topography and the minimum <br /> requirement of the Building Inspector. <br /> Pat stated that he is in favor of having access to the pond, <br /> Mrs , Neet, abutter, stated that she has a driveway on Cove Road <br /> which has been (and can be) used to turnaround. <br /> Mr. Fitch discussed the relocation of Pimlico Pond Road. He <br /> found out that Mr. Nikulas has paid $75,000 of the $100,000 <br /> promised towards improvements. However, $75,000 is gone, it has <br /> been used to re pave a portion of Pimlico Pond Road, There is <br /> still $25, 000 due. <br /> Mr. Fitch explained that the understanding the applicant has with <br /> the Town is that the Town will do the work. None of the lots can <br /> be used until the covenant will be released and as a practical <br /> matter, 3 of the lots are "hostage" to the completion of the <br /> road. They are taking a risk that the road will get done and <br /> they have to believe the promises mane will be carried out. Who <br /> will do the work becomes the concern of the applicant. <br /> They may end up building the road. <br /> Judy asked if the cul de sac will be eliminated? <br /> Mr. Thompson stated they will have to find out how much paved <br /> frontage is required before they can make that decision. <br /> Pat asked what is the recourse if the town doesn' t do the road? <br /> Mr. Fitch stated that they could build it themselves or they <br /> could seek to abandon the plan. The whole thing was motivated by <br /> a request by this Board and DPW and the applicant was encouraged <br /> to do it, Mr, Fitch truly believes the town will come through. <br /> Tony stated that if the road doesn't get done, then there are <br /> over 12 more lots with access on Pimlico Pond Road at its most <br /> dangerous area. That has to be put into the equation. His <br /> bigger-t concern is that it defeats all that is trying to be <br /> accomplished on both sides of the table. Everyone would look at a <br /> subdivision in proximity to that totally differently then they <br /> are today t police, fire, etc. ) <br /> Mr. Fitch stated that given that statement then why proceed if <br /> they are going to bear the entire responsibility? If they go <br /> forward and the whale thing falls apart then they lose <br /> everything. If that is the case, then they will not go a step <br /> further. <br /> 3 <br />
