The Planning Board is paralyzed with <br /> Bufflehead Bay. Technically they have had free zoning protection <br /> for all this time. She is hoping the Commission doesn' t fall <br /> victim to the same process, it is not fair. <br /> Mr. Benway stated one of the Commissions concerns has been, in <br /> refusing to continue a matter, would mean the applicant will <br /> have to apply all over again and the fees are extensive. They do <br /> not just runt to stop the clock. All the commission members vote <br /> on this. <br /> Tony stated the Commission would like to see the Mashpee Commons <br /> application become a win-win situation. They see it as a pilot <br /> application and they will go through it together. <br /> Mr. Benway stated they are trying to coordinate the State <br /> requirements with what is required by the Commission. <br /> Tony stated his impression regarding the Mashpee Commons <br /> application is that because of the magnitude of the project and <br /> the ability of the applicant to put money into high duality <br /> services (traffic, water, etc. ) the Commission was interested in <br /> working with the applicant. <br /> Judy stated that if the plan has not reached the point were it <br /> can be reviewed, if it is in the visionary stage should it be in <br /> the application process at all or are they just extending zoning <br /> protection. <br /> With the Bufflehead Bay plan, what is the justification for 7 <br /> years, either they are ready with the plan or they are not. <br /> Mr. Benway stated that it is not that Gut and dry. <br /> Tom explained that the whole Mashpee Commons project is in there <br /> because it is under MEPA review, which triggers Commission <br /> review. <br /> Tom stated that he is curious as to what happened' to all the <br /> other projects they referred up there? <br /> Mr. Benway explained (and outlined a project before the <br /> Commission as an example) that the MEPA process automatically <br /> triggers it and anyone can make an application to the Commission, <br /> whether the project meets local zoning or not. <br /> 2 <br />
