Mr. Benway will return on the 3rd Wednesday in January at 6: 30 . <br /> PERFORMANCE GUARANTEE <br /> Application: prime Properties/ Ron Roux <br /> Location: Falmouth-sandwich Road/Ashumet Pond <br /> Request-, Reduction of performance guarantee for road <br /> improvements at Lakeshore subdivision ($10 , 00 <br /> passbook is being held by Treasurer) <br /> Mr, Ron Roux was present to request a reduction of the band the <br /> Board was holding for $10,000. <br /> He would like it reduced to $1,500. <br /> The grass on the road shoulders has come in. <br /> He has discussed this with Charlie and Tom_ <br /> Charlie stated that the road looks good, the grass has taken <br /> hold. <br /> Wayne made a motion to reduce the bond to $1 , 500 . Judy seconded <br /> the motion. All Board members were in favor, <br /> The Board signed the necessary paperwork. <br /> PUBLIC HEARING <br /> Applicant: Ethelleen and Louis Antunes <br /> Location. Quinaquisset Ave./Orchard Road <br /> Request: Continuation of public hearing to review special <br /> Permit Application and Definitive Plan for a 12 lot <br /> cluster subdivision. Decision on Definitive Plan <br /> must be filed by January 30 , 1992. Decision on <br /> Special Permit must be filed within 90 days of close <br /> of public hearing. <br /> Tony Ferragamo stepped down and left the room, <br /> Mrs. Antunes was present and Mr. Jahn 5lavinsky from Cape and <br /> Islands Engineering was present. <br /> Mr, slavinsky explained at the last meeting they were discussing <br /> the re--alignment of Orchard Road with Mashpee Neck Road. The <br /> Board was going to get an opinion from Town Counsel as to whether <br /> it would create a taking if the Board were to require the area <br /> where lot 4 is to. be open space. <br /> Judy read the response from Town Counsel. He is against creating <br /> a 30 foot strip of open space there (lot 4) because it would be <br /> of little value. They would be requiring the developer to create <br /> open space with little value and lower the value of the property. <br /> He would suggest the developer to voluntarily place a restriction <br /> on the lot to require that any building be sited as far away from <br /> the road as possible. <br /> He recommended that they make lot 4 large enough to accommodate <br /> the re-alignment in the future with little harm to the owner of <br /> the lot. <br /> 3 <br />
