3. Request for Variance from Cesspool Regulation—7 SUppersheUVVay. <br /> Mr. Harrington commented that the property at S|ippershe|| Lane is currently serviced by <br /> cesspool and the property is |n the process of being sold. 4 septic design p|anwasapproved on <br /> June 1[L2O21 for two bedrooms. Due to the cesspool servicing the dwelling,the Board ofHealth <br /> requires the cesspool tobe upgraded prior to the sale of the property. Therefore, a variance has <br /> been requested to transfer the property without the system being upgraded. The property is <br /> being sold as is. Mr. Harrington remains unsure of the buyer's intentions for the property. Their <br /> representative is present this evening. The Board needs to determine the enforcement <br /> agreement, mitigation for variance, time frames for issuance of agreement, and time frames <br /> based upon future use of the property. He did speak with the buyer and they were looking to put <br /> an Innovative Alternative system.This will be a tear down, raze, and rebuild. <br /> Kim Christiansen stated her name for the record. She is here in on behalf of her client,the buyers <br /> of this property. There were lots of things wrong like lead paint,termites,and they want to keep <br /> the water healthy.They would like to get a better system like MicroFAST.They will not be using it <br /> until it has an occupancy permit. <br /> Mr. Harrington stated the mnin|nnurn for Title G has to be three bedrooms. There xvmu|d be an <br /> increase in flow and they would have to do other things to meet full compliance of the code. <br /> Mr. Qaumgaerte| noted that leaves the enforcement agreement. <br /> Mr. Harrington commented because the house is going to be torn down,the Board condemns it <br /> on the date of the sale orsome period after that. The condemnation is set until house iotorn, <br /> the septic is redesigned, installed, and compliance is issued and occupancy is issued.The <br /> agreement ia just determining the date for those items. <br /> Mr. Baumgaertel noted the property is not transferred at this point.Would the condemnation <br /> route throw anything off in terms of transfer, like a different buyer orif the deal fell through? <br /> Ms. Christiansen cannot close on the home until there is an enforceable agreement from the <br /> town. Closing is set for July 28t». <br /> Mr. Harrington could set the Board condemnation to 30 days after the property transfer so it <br /> doesn't affect closing. Condemnation takes effect and building permits are obtained to go <br /> through the process.This means the town is involved and typically if the house would be reused <br /> it would need inspection prior to re-occupa ncy. This is a whole new house with a new septic. <br /> Ms. Christiansen inquired if they wanted to store something that is okay,theyjust can't stay <br /> overnight. <br /> Mr. Harrington typically does not set dates because it could take longer to build and the way <br /> materials are with costs and delays they will just goby the occupancy and septic completion <br /> with compliance prior to occupancy. <br /> There being no further comments ordiscussion, Kripani Patel moved that the dwelling will be <br /> condemned 30 days after dosing and until occupancy is granted, the condemnation of the <br /> dwelling stays in effect until the septic installation and occupancy permit are obtained.
