There being no further comments or discussion, Kripani Patel add the review of septic design plan <br /> for 19 Coombs Lane to the agenda. Motion seconded by Ernest Virgilio. Roll call vote: Ernest <br /> Virgilio (yes); Kripani Patel(yes); Brian Baumgaertel (yes). VOTE: Unanimous(3-0). <br /> Review of Septic Design Plan — 19 Coombs Lane. Mrs, Willander commented that the original <br /> plan that was sent showed incorrect elevation over the distribution box in profile, and the SAS <br /> size was labelled incorrectly on the site plan. A revised plan was submitted today, and no issues <br /> were identified. <br /> Chair Baumgaertel commented that there should be a minimum of 6" compacted crushed stone <br /> instead of just crushed stone base under the dbox and tank. There is no riser indicated on the <br /> dbox. Chair Baumgaertel inquired whether there were any variances requested for the design <br /> plan to which Mrs.Willander stated no variances were requested. <br /> There being no further comments or discussion, Kripani Patel moved to approve the septic design <br /> plans for 19 Coombs Lane with the following conditions: <br /> • Note indicating that there are 3 galleys in the leach system be corrected to read 2 galleys <br /> • Note concerning the crushed stone base beneath the septic tank and dbox be amended <br /> to indicated compated stone base <br /> • Riser on dbox is indicated in system profile <br /> • Note is added regarding variances such to indicate that no variances are requested for <br /> this <br /> • Provided that the porch indicated as the covered porch on plans is on pilings and not on <br /> a concrete slab <br /> Motion seconded by Ernest Virgilio. Roll call vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian <br /> Baumgaertel (yes). VOTE: Unanimous(3-0). <br /> 8. Review of Compliance—88 Lakeside Estates. Mrs. Willander commented that, on June 2, 2021, <br /> at the request of the new owner, Health Agents performed an inspection of the dwelling at 88 <br /> Lakeside Estates,300 Nathan Ellis Highway, Mashpee, MA. Based on the results of that inspection <br /> and pursuant to M.G.L.c111,§127(B)and 105 CMR 410.831(D),the dwelling was found to be unfit <br /> for human habitation. On June 10,2021, Health Agents posted an Emergency Condemnation and <br /> Order to Vacate on the dwelling and, on June 17, 2021, the BOH voted to affirm the Emergency <br /> Condemnation. <br /> An Order to Secure letter was sent to the owner of record/complainant on June 10, 2021, which <br /> the owner signed for on June 15, 2021. The order provided notice that, according to 105 CMR <br /> 410.831(F) if, after one year of issuance of the order to secure, compliance with the minimum <br /> standards set forth in 105 CMR 410.00 was not met, the BOH may cause the dwelling to be <br /> demolished or removed. It further stated that, if the property owner failed to remove or abate <br /> the violations,the Town would address the violations at the owner's expense and, if the debt was <br /> not repaid to the Town,the amount would be placed as a lien against the property with interest <br /> accrued at 6% per annum (per M.G.L. c 111, §125). <br /> Since June 10, 2022 marks one year since the order was issued and posted, and the BOH has had <br /> no further contact with the owner to re-inspect to verify compliance, the Board should vote on <br /> what steps should be taken next. Health Department staff last visited the property on June 11, <br /> 2022, and found it was posted, but did not try to access the dwelling. <br />
