concerns about where the Town would attach any related liens.There has been no response yet <br /> from legal counsel; however, since the last BOH meeting, the Health office has fielded close to a <br /> dozen calls from individuals looking to purchase the property and fix it up. Each of those callers <br /> indicated that they had been told by the realtor working for Mr. Haney that he had re-acquired <br /> the property as a result of it having been abandoned, and that he was selling it "as is". Ms. <br /> Willander advised each of the callers that she would need to get a determination from the Board <br /> as to whether a condemned property could be sold and, if so,what timeframe they would set for <br /> bringing the property into compliance. <br /> On Monday,August 1, Mr. Haney called the Board of Health to say that MEZ Realty had put a lien <br /> on the property, and he is taking the position that the property is abandoned. He further stated <br /> that he did not want to take responsibility for demolition or upgrade of the trailer, but he had <br /> buyers on stand-by who are planning to fix it up.When Mr.Haney was asked under what authority <br /> he believed he could take possession of the property, he answered that he had sent multiple <br /> letters to the owner and "there are mechanisms in place" whereby Mr. Haney could re-acquire <br /> the property as a result of it having been abandoned. He argued that it was better to sell the <br /> property to someone who is willing to fix it, then to let it sit in its current state of disrepair. Ms. <br /> Willander stated that she advised Mr. Haney that this matter would be taken up by the Board at <br /> the next meeting. Assuming Mr. Haney has the legal right to sell the property,the Board should <br /> decide whether they would allow the property to be sold as-is and, if so, set a timeframe for <br /> repair. Chair Baumgaertel stated, from the standpoint of the Board of Health, that the owner, <br /> whoever that may be, could have the opportunity to repair it so it is compliant to the State <br /> Sanitary Code. Chair Baumgaertel further stated that he did not feel that was up to the Board to <br /> determine ownership. However,the Board did agree to set a timeline, since it's been a year. Ms. <br /> Willander suggested the timeline start on the date of transfer and possibly give the owner 6 <br /> months. Chair Baumgaertel looked at the list of items to make the trailer habitable, the most <br /> concerning being the asbestos, and suggested 90 days. <br /> There being no further comments or discussion, Brian Baumgaertel motioned that the owner, <br /> MEZ Realty, resolve the sanitary issues by making repairs to the trailer unit 88 at Lakeside Estates <br /> at 300 Nathan Ellis Highway or demolish the building within 90 days of the meeting. Motion <br /> seconded by Ernest Vigilio. Roll Call Vote: Brian Baumgaertel (yes); Ernest Vigilio (yes). VOTE: <br /> Unanimous(2-0) <br /> 7. COVID update: In the last week, twenty-five (25) new positive COVID-19 cases were added and <br /> no deaths. Twenty-one (21) cases moved out of isolation. There were eight (8) cases in <br /> isolation. The total running case count was 2367. Ms. Willander commented that combined Flu <br /> and Covid Booster clinics were being planned for the fall. Typically, flu vaccines were <br /> administered at the clinic on a walk-in basis; but pre-registration would be required for the <br /> combined clinics. <br /> NEW BUSINESS: <br /> 1. Review and approval of Meeting Minutes.There were no minutes ready for review. <br /> 2. Review and approval of expense warrants. Expense warrants were signed. <br /> 3. Review of Draft Sewer Regulation. Ray Jack, Town Engineer, attended the meeting for the <br /> purpose of discussing the draft Sewer Regulation. He provided the Board with a detailed update <br /> on the status of the sewer plan/phases, and provided insight into a various interpretations, <br /> definitions,timelines and requirements. <br />
