MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 27,2022 <br /> Mr. Reidy read the Board of Health,Town Engineer,and Conservation comments into the <br /> record. <br /> There were no abutters present. There were no more comments from the Board. <br /> Mr. Bonvie made a motion that the Board issue a Written Finding to Michael and Christine <br /> Butera of 186 Ninigret Avenue under §174-17 of the Zoning Bylaws to allow for an <br /> addition, extension of a pre-existing, non-conforming dwelling on property located in an <br /> R-3 Zoning District, Map 65 Parcel 91, Mashpee, MA,with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 2. Existing Conditions Plan with Addition — Prepared for Christine Butera, 186 <br /> Ninigret Ave., Prepared by: Baxter Nye Engineering & Surveying, Sheet: C 1.0, <br /> Date: September 14, 2021, Scale: 1" = 10', Drawn by: SDM, Checked by: SMM. <br /> Date: 4/22/22—Added House Addition. <br /> 3. Conditioned on all Town Department comments read into the record including but <br /> not limited to the Board of Health comments. <br /> 4. Conditioned that any changes to the plans will require the applicant to return to the <br /> Zoning Board of Appeals. <br /> 5. The applicant must submit confirmation to the Building Inspector that the building <br /> will not exceed the required maximum building height regulation prior to applying <br /> for a building permit. <br /> Mr. Gould seconded, yes <br /> Mr. Pittsley, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Bonvie, yes, <br /> Mr. Furbush, yes. <br /> All were in favor of the Written Finding for the second story addition. <br /> 46 Little Neck Lane: Petitioner, Timothy Luff requests a Variance under §174-33 <br /> (Setbacks from wetlands) of the Zoning Bylaws for a raze and replace of a single family <br /> dwelling on property located within the New Seabury Special Permit Area,Map 105 Parcel <br /> 14, Mashpee, MA.
