MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 27,2022 <br /> Mr. Tim Luff represented the Variance request. The existing conditions setback from <br /> wetlands is 15 ft., and the proposed will be 18 ft. He read the comments from the Board of <br /> Health and will comply with their requirements. The project has minor modifications that <br /> were approved by the Board of Health. The project was approved by the Conservation <br /> Commission, and readjusted the plan that was acceptable to their requirements. <br /> The location is within the New Seabury Special Permit-area so there is no height or lot <br /> coverage requirement,but the lot coverage will be improving from what exists,and will be <br /> at or below the 35 ft. height of the average grade. <br /> ... ....... <br /> Ms. Sangeleer read the Board of Health, and Conservation Department comments into the <br /> record. <br /> Mr. Gould read the Town Engineer comments into the record.No issues. <br /> Mr. Bonvie confirmed with the Dave Morris that the only relief required is the setbacks <br /> from the wetlands, and this Board has no jurisdiction for other requirements because of the <br /> existing Special Permit issued to New Seabury. <br /> Mr. Luff had a meeting with Dave prior to the hearing to discuss the ZBA application. <br /> There were no more comments from the Board. <br /> Mr. Reidy made a motion that the Board issue a Variance to Petitioner, Timothy Luff <br /> requests a Variance under §174-33 (Setbacks from wetlands) of the Zoning Bylaws for a <br /> raze and replace of a single family dwelling on property located within the New Seabury <br /> Special Permit Area, Map 105 Parcel 14, Mashpee, MA. (Owners of Record: Julie Silva <br /> and Martin J. Reilly) with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance <br /> under Mass General Law 40A Section 10. <br /> 2. Site Plan— Proposed House Reconstruction, 46 Little Neck Lane, Mashpee, MA. <br /> Scale: 1" = 10', Date: January 27, 2022, Drawn by: RAR, TJB, Checked by: TB, <br /> Job Number: 21039, Existing Conditions Sheet 1 of 2, Drawing Number: B28-53. <br /> Stamped and Signed by: Thomas J. Bunker, Professional Land Surveyor No. <br /> 32653. <br /> 3. Conditioned on all Town Department comments read into the record including but <br /> not limited to all the comments and conditions set by the Board of Health. <br /> 4. The Board issues a Variance from the wetlands in the amount o£ 32 ft. <br /> 5. Conditioned that any changes to the plans will require the applicant,to return to the <br /> Zoning Board of Appeals. <br /> 3 <br />
