MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 27,2022 <br /> Mr. Gould seconded, yes <br /> Mr. Pittsley, yes <br /> Mr. Reidy,yes <br /> Mr. Sangeleer, yes <br /> Mr. Bonvie,yes <br /> All were in favor of the Variance request. <br /> Sitting on this hearing are the four regular Board members and Mr. Caggiano. <br /> 58 Ca wu a Avenue: Owners, Charles and Ellen Horne request a Special Permit under <br /> §174-17.1 (Raze and Replace) and §174-33 (Setbacks from Wetlands) of the Zoning <br /> Bylaws to allow for a raze and replace of a pre-existing non-conforming dwelling on <br /> property located in an R-3 Zoning District,Map 65 Parcel 9, Mashpee, MA. <br /> Attorney, John McTernan representing the applicant for the raze and replace project. The <br /> current dwelling is pre-existing non-conforming three bedroom structure, and will be <br /> replaced with a new code compliant three bedroom structure. The lot is approximately <br /> 14,073 sq. ft., has 86.97 ft. of frontage, and the present requirement is 40,000 sq. ft. and <br /> 150 ft. of frontage. The property backs up to John's Pond at 32 ft. which exceeds the 50 ft. <br /> minimum. <br /> The proposed ranch-style structure will be built roughly in the same place but is slightly <br /> larger. The new dwelling will meet both side and front setbacks. The distance from the <br /> wetlands will remain at 32 ft.The new structure will have a walk-out basement with a two- <br /> car garage and driveway for adequate parking. The septic system will be replaced with a <br /> new d-box and tank. The area has many homes that have been upgraded over the past <br /> several years,and will be a substantial increase in value of this parcel and abutting parcels. <br /> The Conservation Commission issued an Order of Conditions,and the Board of Health has <br /> one minor change that needs to be made with the distance of the dry well to the leaching <br /> field. <br /> Mr. Furbush mentioned that the new dwelling does not need any variances, the dimension <br /> on the North side is 15 ft., and will be 15 ft. on the South side, and 40 ft. from the front, <br /> and the rear will be the same. The deck is included in the lot coverage. <br /> Mr. Bonvie asked the applicant what the request for relief from the wetlands would be.The <br /> applicant said; 18 ft. <br /> Mr. Bonvie had concerns regarding the setbacks of the new dwelling and if there is enough <br /> space provided for construction. Mr. Morris said that he will be reviewing the project very <br /> closely. <br /> 4 <br />
