MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Petitioner, Capewide Construction, Inc. <br /> Owner of Record: Timothy E. Tuttle and <br /> Cheryle R. Tuttle, Trustees of Tuttle Joint Trust <br /> 19 Mercantile Way(Map 88 Parcel 105) <br /> Mashpee, MA 02649 <br /> SP-2022-28 <br /> A letter dated July 26, 2022 submitted by the Fire Department stating that the site plan and the <br /> paint booth are required to comply with the Mass Fire Code 527 CMR1.00, Chapter 43 and <br /> NFPA 33. These conditions are incorporated into this decision. <br /> Attorney Kirrane said that the site plan was revised to include two more parking spaces, for a <br /> total of fifteen (15), for the warehouse/showroom building. The allowed parking would be on <br /> the side or the rear. The Board at their discretion could allow six parking spaces in the front of <br /> the building as indicated on the revised plan. <br /> Mr. Bonvie addressed the Board and mentioned that there were recommendations dated May 17, <br /> 2022 submitted by the Plan Review Committee for the ZBA, specifically the parking. He said <br /> he is satisfied with those revisions. He polled the Board, and there were no issues. Mr. Bonvie <br /> mentioned that the other items on the list were addressed by the Fire Department and the Board <br /> of Health. <br /> The Board has secured Mr. Ed Pesce, Pesce Engineering to provide his peer review services and <br /> review the proposed project because the Town does not have an engineering employee. Mr. <br /> Pesce provided the Board his engineering report dated July 25, 2022, and will be conditioned <br /> into this decision. <br /> Mr. Bonvie said that all revised plans should be given to the Building Commissioner and <br /> reviewed on behalf of the Board prior to issuance of a building permit. <br /> The Board of Health letter to Mr. Matthew Eddy, dated July 7, 2022 and July 20, 2022 was read <br /> into the record. A letter dated July 26, 2022 from the Fire Department was read into the record. <br /> Attorney Kirrane and his client agreed to the conditions discussed with the Board. <br /> There were no more comments from the Board. <br /> GENERAL CRITERIA <br /> The subject property located at 19 Mercantile Way is approximately 44,516 square feet. <br /> There were no abutters present. <br /> 2 <br />
