MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DULY 13,2022 <br /> Attorney Christopher Kirrane represented the applicant Capewide Construction. Also present <br /> was Roger Brooks, with Capewide Construction, John LaValle, with Baxter Nye Engineering. <br /> The property is located at 19 Mercantile Way in the I-1 and Light Industrial Overlay District. <br /> The building is a typical Morton style building similar to other buildings located in this <br /> development. The lot is 44,516 sq. ft. lot with 200 ft. of frontage. The footprint of the building <br /> is 7,272 sq. ft. There is a proposed mezzanine and a revision will be made to a revised plan. The <br /> floor plan that is shown is a bit larger than what the building code defines as a mezzanine. A <br /> mezzanine can only be one third of the underlying floor area, so a revision will be made to make <br /> sure that it meets the building code requirement. <br /> The mezzanine is currently shown on the plan as 2,419 sq. ft., and will be revised to 2,349 sq. ft. <br /> which will meet the definition under the building code. The mezzanine is basically a second <br /> floor. <br /> Mr. Roger Brooks said that the owner is not sure how he intends to use that open space. He plans <br /> to have a show room and cabinet making facility but there will be a stairway to the mezzanine. <br /> Chairman Furbush mentioned the notes submitted by the Plan Review Committee and wanted to <br /> know if the applicant is asking for the approval of the building and the uses at the same time. <br /> Attorney Kirrane said; yes. If the project is approved by the ZBA, Greg Clancy Construction, <br /> and will be utilizing a portion of the building for cabinetry making for his clients that are in the <br /> process of building their home or that is under construction for a kitchen, etc. The showroom is <br /> not open to the public; it's by appointment. <br /> Mr. Goldstein said that Clancy Construction has a cabinet shop but is looking to have his own <br /> building. <br /> Mr. Bonvie asked if the conditions were met from Plan Review. Attorney Kirrane said; yes. The <br /> paint booth was approved by the Fire Department, and the parking lot for the septic system was <br /> approved by the Board of Health. Mr. Bonvie wanted confirmation that the Plan Review <br /> Committee was satisfied with the conditions that were submitted. <br /> The Board would like the plans reviewed and approved by a Town official or someone qualified <br /> that all conditions are met. Attorney Kirrane said that most of the conditions were met with the <br /> exception of the revised plans regarding the parking that the ZBA needs to review. <br /> Mr. Reidy went through the conditions on the Plan Review list and mentioned that the Board of <br /> Health is involved with all of the items except for the parking. <br /> The Board would like to continue the petition based on their discussion regarding the parking, <br /> and they are requesting revised comments from some members of Plan Review Committee. <br /> Attorney Kirrane requested a continuance until Wednesday, July 27, 2022. <br /> 3 <br />
