Mr. Virgilio stated if it is getting too late, people will just have to be called back.

Mr. Harrington pointed out the next meeting has two executive sessions. Counsel is waiting on
th
two topics that need to be covered. The Board has to meet on July 17, as he already told Counsel.
Executive sessions can be covered first and if the meeting is running late the Board has the
discretion to continue until next meeting.

Mr. Harrington stated the people who show up will be taken care of first. If they don’t want to
represent their story they can be moved to the bottom. People who show up will take precedence.
He also noted the fireworks will happen but there will be no vendors this year.

Mr. Virgilio reminded everyone the population in town will double for fireworks.

NEW BUSINESS

1. Review and approval of meeting minutes. There were no minutes prepared for review.

2. Review and approval of expense warrants. Expense warrants were signed. Mr. Harrington
wanted to acquire all three signatures in person to make it easier.

3. Title 5 Variance Request – 126 Summersea Road. Mr. Harrington commented that a variance is
being requested from Title 5 to allow a proposed soil absorption system to be constructed 5 feet
from the northerly property line at abutter 130 Summersea Road. No septics are located within
10 feet of the proposed septic tank. The abutters were to be notified due to the property line
variance.

Jeffrey Ryther with BSS Design is present on behalf of the applicant. There is the variance that Mr.
Harrington mentioned, but he has a list of seven variances around the septic tank and the Soil
Absorption System (SAS) to lot lines at the southern wall and one variance to the salt marsh off
the west. There are 7 total:
- SAS less than 10 ft. to road layout, 9 ft., 1 ft. variance
- Septic is less than 10 ft. to garage floor, 8 ft., 2 ft. variance.
- Water surface less than 10 ft. to SAS, 7ft., 3 ft. variance.
- Septic, now SAS, less than 10 ft. to the garage, 9ft., 1 ft. variance.
- Septic tank less than 10 ft. from the road layout, 8 ft., 2 ft. variance.
- SAS is less than 100 ft. to the salt marsh lot line, 84 ft. to salt marsh.

Mr. Harrington stated the SAS setback to the wetland is now 75 ft., it is okay where it sits. He
asked if the waterline is going to be sleeved for the variance.

Mr. Ryther responded yes, there is a note to close water service to the curb stop.

Mr. Baumgaertel asked if this is this a complete tear down re-build?

Mr. Ryther stated that it is proposed three bedroom and existing is three bedroom.

Mr. Harrington commented that the existing plan has the tank and pump chamber right in the
coastal bank and the leach pit is partially off the property, this is a substantial improvement from
what is there.

3
