Ms. Robson asked again, who is determining where the pond ends and where the woods begin? <br /> She feels that the starting points are in the woods and not the pond. Mr. Harrington answered <br /> an aerial photographs overlays,which is how GIS works. Ms. Robson asked why these maps <br /> where used for a legal order when they clearly state that they should not be used for legal <br /> matters.She claimed that the maps are used for inventory and assessing parcels only. She <br /> understands why the legal order was made,what she had difficulty understanding is the starting <br /> point. <br /> Mr.Virgilio commented that he was not going to comment or make any decision without factual <br /> information. <br /> Ms. Patel commented that this survey has been going on for a few months and this appeal is <br /> only coming up now. She asked what drew you to have such a late appeal to the order?Ms. <br /> Robson answered that she has been in communication with Mr. Harrington. She stated that his <br /> answer is always, "it has to go in front of the Board" <br /> Board members and Mr. Harrington commented on possible directions to take this matter, <br /> Town Council,Supreme Court. <br /> The owners waited until the last minute to appeal. The owner is going to ask for the town to <br /> pay for the land surveyor. Discussion of Title 5 failures in Phase 1 Sewer Project Mr. Harrington commented that he <br /> drafted a memorandum that he sent to the Town Manager about the Sewer Project. He further <br /> commented that at the BOH meeting held on January 6, 2022,the Board discussed strategies for <br /> addressing failed septic systems within Phase I of the sewer project. As Title 5 does allow <br /> extensions to be granted by the Board of Health,the Board asked that newly identified failed <br /> systems located within Phase 1 of the sewer project be brought to their attention. If an <br /> extension is to be considered, a request should come from the property owner, as an agreement <br /> must be executed between the Board of Health and the owner. A boiler plate letter has been <br /> drafted, notifying owners of the failures, and outlining their options to repair/upgrade the on- <br /> site system or request an extension up to five years. <br /> NEW BUSINESS: <br /> 1. Mr. Harrington commented that <br /> a variance has been requested to allow a two-bedroom dwelling be constructed with no <br /> naturally-occurring pervious soil above groundwater as required by Part IX Section 12 of our <br /> regulations. Historically,two properties have had this variance approved 265&266 <br /> Monomoscoy Road. In both cases a composting toilet with a gray water Title 5 system were <br /> required. In this case, a Busse Model 250 is being proposed. The effectiveness of the Busse <br /> system in regard to nitrogen removal and is about 61%TN removal. The phosphorous unit <br />
