MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
MARCH 8, 2023
Mr. Furbush asked if planting could be installed around the basin. Mr. Dibb said that plantings
could be installed. They are only clearing enough area to install the basin. This is a bigger
depression to manage the area of the new roof, all the pavement along the back of the property,
and most of the pavement on the south side as well.
Mr. Dibb said that it's built to withhold a 25 year storm. He does not anticipate a larger storm
event, or larger overflowing.
Mr. Bonvie asked if the design was for a 25-year storm event, and if this project required Plan
Review. Attorney Kirrane said that he spoke to the Building Commissioner and the Town Planner
and did not require their review.
Mr. Bonvie said historically he thought this would require to be designed for a 100-year storm.
Mr. Dibb said that additional storage could be installed within the underground storage, and also
provide emergency overflow to the parcel and that will ensure no overflow. Mr. Dibb said that
they design to ensure flooding will not impact other areas for 100-year storm, but the components
themselves are not always designed to handle that. They design excess storage in parking lots.
Mr. Bonvie is very concerned with the drainage calculations of a 25-year storm calculation. He
suggested that the Town Engineer review the project.
Mr. Bonvie amended his motion to accept the applicant's Attorney Chris Kirrane's request for a
continuance until March 22, 2023. Mr. Gould seconded. Mr. Caggiano, yes, Mr. Gould, yes, Mr.
Blaisdell, yes, Mr. Bonvie, yes, and Mr. Furbush yes.
Sitting on this hearing are the four regular Board members and Associate, Brad Pittsley
800 Falmouth Road: Petitioner, CatDogg LLC requests a Special Permit under §174-24 (K) and
§174-25 (E) (16) of the Zoning Bylaws to allow for an adult-use cannabis retail facility and
marijuana product manufacturing facility on property located in an I-1 Zoning District at 800
Falmouth Road, Units 102A and BIA, Map 88 Parcel 2, Mashpee, MA. (Owner of Record: Kevin
P. Andrade, Trustee of Surnmerfield Park Realty Trust).
Mr. Rob Catania, 565 Whistle Berry Road, Marston Mills, represented the proposed business
located at 800 Falmouth Road, Mashpee. Also present was Evan Lehrer, President of CatDogg,
LLC. He is known as the Town Planner for the Town of Mashpee, but is representing his interest
in the business along with his associate Rob. He confirmed that in the interest and pursuit of this
business, and particular petition, he filed a non-disclosure conflict of interest form with Town
Manager and is part of the record.
11
