<br /> ➢ Review and Discussion of Open Meeting Law Complaints relative to March 8, 2023
<br /> meetings relative to 228 Wading Place Road Special Permit (Complainants: Beth
<br /> Andrew-Berry, Barbara Lynne Barbee, Glenn McCarthy, and Barbara Reilly): Vote
<br /> to authorize Town Counsel to respond to all four complaints.
<br /> Chairman Furbush read a synopsis of the Complaints. The Complaints assert that the
<br /> referenced Executive Session was improper because the litigation cited as the basis therefor
<br /> had concluded with Land Court's issuance of the remand order/judgment, and the Barbee
<br /> complaint alleges a second violation based on alleged improper email/communication
<br /> among Board member outside the public meeting.
<br /> Mr.Furbush asked the Board members if they all read the four open meeting law complaints.
<br /> He asked if there were any comments or questions. There were no questions or comments
<br /> by the Board. He asked the Board members if they had any improper email/communications
<br /> with other Board members outside the public meeting. There was no improper emails or
<br /> communications with other Board members.
<br /> There was no further discussion.
<br /> Mr. Furbush asked Mr. Bonvie to make a motion to close the public comment. Mr. Bonvie
<br /> made a motion to close public comment in reference to open meeting law complaints. Mr.
<br /> Ganzenmuller seconded. Mr. Caggiano, yes, Mr. Pittsley, yes, Mr. Ganzenmuller, yes, Ms.
<br /> Sangeleer, yes, Mr. Goldstein, yes, Mr. Bonvie, yes, Mr. Blaisdell, yes, and Mr. Furbush
<br /> yes. The public comment was closed.
<br /> Mr. Furbush asked Mr. Bonvie to make a motion on each separate open meeting law
<br /> complaint.
<br /> Mr. Bonvie made a motion that the Board authorizes Town Counsel to issue a written response
<br /> relative to the disposition of the Open Meeting Law Complaint filed by Glenn McCarthy on April
<br /> 3, 2023. Ms. Sangeleer seconded. Mr. Caggiano, yes, Mr. Pittsley, yes, Mr. Ganzenmuller, yes,
<br /> Ms. Sangeleer, yes, Mr. Goldstein, yes, Mr. Bonvie, yes, Mr. Blaisdell, yes, and Mr. Furbush,
<br /> yes. All were in favor.
<br /> Mr. Bonvie made a motion that the Board authorizes Town Counsel to issue a written response
<br /> relative to the disposition of the Open Meeting Law Complaint filed by Beth Andrew-Berry on
<br /> March 27, 2023. Mr. Ganzenmuller seconded, Mr. Caggiano, yes, Mr. Pittsley, yes, Mr.
