(Owner of record: Chapter Closed, LLC).
40 Ever green Circle. Petitioner,Pastore Excavation,Inc. requests a Variance from the front yard
setback under§174-31 (Land Space Requirements)of the Zoning Bylaws to allow for construction
of a metal commercial building with contractor bays on property located in the I-1 and Light
Industrial Overlay District(s), Map 19, Parcel 10-4, Mashpee, MA. (Owner of record: Chapter
Closed, LLC).
Sitting on these hearings are the four regular Board members and Associate Member, Sharon
Sangeleer.
Attorney Christopher Kirrane represented the applicant for the Modification request to an existing
Special Permit(SP-2021-34). Also present was Mark Dibb with Cape&Islands Engineering. This
location was previously approved by the Board for a Contractor's yard, and the applicant is now
seeking a Modification to construct a 7,500 sq. ft. Morton style metal building on this lot for
contractor bays under the bylaws. There is one relief request for a 1 ft.variance from the front yard
setback. There is a 70 ft. setback requirement from the front, but this building is setback further
than the adjacent building, and the Board may find this de minimis because of the shape,
typography of the lot, and the fact that it is on a cul-de-sack.
13
