<br />MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />MAY 10, 2023 <br /> <br />Ms. Sangeleer read an email sent to Zack Seabury, Board of Health Agent from Raul Lizardi- <br />Rivera dated May 8, 2023 into the record: “Attached is the floor plan the homeowner received <br />when he purchased the property. There are three (3) bedrooms in the second floor, and one (1) den <br />in the first floor.” <br /> <br />Mr. Goldstein wanted to confirm on the site plan that the existing shed to be razed is the lighter <br />faded color. Mr. Lizardi-Rivera said; yes, the new building will be (5) feet from the property line. <br />There was no garage there prior. <br /> <br />Mr. Morris said that the shed is pre-existing, non-conforming and over 200 sq. ft. Mr. Morris has <br />no issue with the five (5) ft. setback. <br /> <br />There were no more comments from the Board or audience. <br /> <br />Mr. Furbush asked for a motion to close the public comments. Mr. Goldstein made a motion to <br />close the public comments for 409 Monomoscoy Road. Ms. Sangeleer seconded, yes, Mr. Pittsley, <br />yes, Mr. Reidy, yes, Mr. Goldstein, yes, and Mr. Furbush, yes. All were in favor to close the public <br />comments. There was no further discussion. <br /> <br />Mr. Goldstein made a motion that the Board approve 409 Monomoscoy Road, Owners, Thomas <br />and Michelle Guard, Trustees request a Written Finding under §174-17 of the Zoning Bylaws to <br />allow for removal of an existing shed, and construct a garage in its approximate location on <br />property located in an R-3 Zoning District, Map 124 Parcel 62-0, Mashpee, MA with the following <br />conditions: <br /> <br />1. The Board has determined that the applicant meets all the conditions of a Written Finding <br />under Mass General Law 40A Section 6. <br /> <br />2. Site Plan – Prepared for: TM Guard Nominee Trust, 409 Monomoscoy Road, Mashpee, <br />MA.
