Minutes of Meeting <br /> Plan Review Committee <br /> Tuesday, February 21, 2023 <br /> Mashpee Town Hall Waquoit Meeting Room <br /> Ms. Fidel presented her request to obtain a dog license for six (6) dogs. She received a letter <br /> from the Clerk's office that requires the appropriate license for multiple dogs. Ms. Fidel said <br /> two of the dogs belong to her daughter. She also mentioned that she had bred the dogs in <br /> the past. A notice of the hearing was mailed to thirty abutters via certified mail. There were <br /> several abutters at the meeting. <br /> Mr. Collins read the letter dated January 4, 2023 into the record. "It has come to my attention <br /> that you have four or more dogs at your residence. The Town of Mashpee requires a notice <br /> of four or more dogs to obtain a kennel license. I have enclosed step-by-step instructions to <br /> apply for a kennel license, and a copy of the Town of Mashpee Board of Health Kennel <br /> Regulations for your reference. Please do not hesitate to contact my office should you have <br /> any questions" from the Town Clerk. <br /> Mr. Seabury mentioned that the Plan Review application had "no breeding", however he found <br /> an online advertisement called "L&M" Lovely Pups with Ms. Fidel's name and address. The <br /> last breed was ready on September 28, 2022, and she has been selling dogs since 2001. Mr. <br /> Seabury commented that there be no breeding or sale of dogs allowed. The Board of Health <br /> has to follow the public health nuisance laws. There can be no complaints of barking, and will <br /> revisit the kennel license. Mr. Seabury mentioned that there's a small discrepancy in the <br /> bylaw. A personal kennel license definition is for anyone possessing four (4) dogs or more. A <br /> commercial kennel license involves boarding. The definition of a kennel license is for anyone <br /> in the Town for personal use. The Board of Health receives notifications from veterinarians <br /> for vaccinations according to the amount of dogs on a given license. <br /> Mr. Morris asked Ms. Fidel if she had a fenced yard. Mr. Fidel said; "yes". Mr. Morris <br /> mentioned that there have been no complaints from abutters that he was aware of. There <br /> were several abutter letters that were not in favor of the kennel license. <br /> Mr. Phelan asked how many dogs are not spayed or neutered. Ms. Fidel said; one. Mr. Phelan <br /> determined that Ms. Fidel has been breeding dogs which is considered a commercial use and <br /> is not allowed in a residential neighborhood. <br /> Mr. Morris read an email into the record submitted on February 20, 2023 from Mr. Lehrer, <br /> Town Planner. <br /> Mr. Collins asked Ms. Fidel if there have been any complaints, and if there are any <br /> neighborhood association bylaws. Mr. Collins asked Ms. Fidel if there was a reason she was <br /> not in compliance. Ms. Fidel said that her daughter has two dogs. Mr. Collins asked Ms. Fidel <br /> if there have been any coyotes in the neighborhood. Ms. Fidel said that she has an 8 ft. fence, <br /> and has been trying to control the barking. <br /> Mr. Balzarini asked if the application should be withdrawn as a breeder. He said that people <br /> have approached him complaining about barking. He believes the lot is too small for six dogs. <br /> 4 <br />
