MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 28,2023 <br /> Chairman Furbush asked the Board members if they had some comments.Mr. Bonvie mentioned <br /> that he did read the report provided by Mr. Pesce, and that he as one member was somewhat <br /> satisfied,but had a couple of items to address. He asked Mr. Leedham if the boat ramp was open <br /> to the public or just for his customers. Mr. Leedham said; his customers. Mr. Bonvie corrected a <br /> statement he made at the last meeting that he made to the audience that the application was for a <br /> new special permit, it is a modification of an existing special permit. <br /> Mr. Reidy read Mr. Pesce's final peer review report into the record dated June 26, 2023. Mr. <br /> Reidy mentioned to the audience that Pesce Engineering is an independent firm that the Board <br /> can call upon to answer questions that the Board is not qualified to answer, and Mark Dibb is the <br /> Engineer for Cape & Islands Engineering. <br /> Chairman Furbush asked Mr. Dibb to comment on the two items that Mr. Pesce addressed in his <br /> report. Mr. Dibb said that the plan set was revised to June 27, 2023 (issued for permit) included <br /> the appropriate engineering stamps, including the Crawford Management Landscape Plan. Mr. <br /> Dibb said that Sheet 3 provides the photometric lighting plan with the corrected lumens. <br /> Mr. Bonvie wanted to review the signed O&M report and wanted this report added to the record. <br /> The O&M report was signed by Mr. Tim Leedham, the owner of the property that he would <br /> maintain and provide the inspections that are listed on this report. Mr. Bonvie would prefer that <br /> a registered engineer will provide the inspections. Mr. Dibb said that an engineer can train an <br /> employee and/or a worker to provide inspections. Mr. Bonvie mentioned that the Board can <br /> condition that a trained professional provides inspections, and monthly inspections. Mr. Bonvie <br /> had a discussion with his concerns regarding O&M inspections. The Board would prefer that this <br /> O&M report, and future O&M reports specifically state the revised language that an assigned <br /> trained professional, either a qualified engineer, or a designee provide the inspections and <br /> maintenance of the site. <br /> Mr. Reidy stated that he reviewed the conditions and recommendations provided by the various <br /> departments, and what was discussed at the previous meeting, and also suggested that the Board <br /> condition subject to approval by the Conservation Commission. Attorney Kirrane mentioned that <br /> his client understands that condition, and that if there are any changes to the plans will require <br /> the applicant to return to the Zoning Board. <br /> Mr. Bonvie wanted confirmation that if there was a change to a plan by the Conservation <br /> Commission, that the applicant would return to the Board, and provide a revised plan. Attorney <br /> Kirrane said that there is a zoning bylaw that the Board could administratively approve a revised <br /> plan.Mr. Dibb said that Sheets 1 and 2 by CLM in the document are the mitigation and landscape <br /> plans. Mr. Furbush stated that the Board would also need to determine if these changes to a plan <br /> or plans are considered a minor or major modification. The Board wants the applicant to <br /> acknowledge and agrees to this request. This request will be required for future projects as well. <br /> 2 <br />
