MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 28, 2023 <br /> The Board received several letters from residents and were read into the record. <br /> Mr. Furbush read the Special Permit bylaw Section 174-24 (C) 2, and he asked the Board to <br /> consider this bylaw when making their determination. <br /> Mr. Reidy was reviewing the list of conditions, and discussed condition number 6. The Board <br /> agreed to amend and strike that the sign remain, and that vehicles enter and exit onto Frog Pond <br /> Close. <br /> Mr. Bonvie confirmed that the owner of the property is "21 Frog Pond Close LLC". <br /> Chairman Furbush asked Mr. Bonvie to make a motion. <br /> Mr. Bonvie to make a motion that the Board issue to Timothy W. Leedham, Manager of 21 Frog <br /> Pond Close LLC,at 21 Frog Pond Close and 352 Mashpee Neck Road a Modification of an existing <br /> Special Permit for the use of the Marina and expand to include the adjacent property located at <br /> 352 Mashpee Neck Road. The original Special Permit were issued under the following entity: (SP- <br /> 83-3-008, SP-00-167, SP-02-59, and SP-2020-06), under §174-24 (C) (9) (b); §174-25 (E); and <br /> §174-17 of the Zoning Bylaws, on property located in an R-3 Zoning District, Map 90 Parcel 83 <br /> and Map 90 Parcel 97, Mashpee, MA. Conditions for this motion are as follows: <br /> 1. Conditioned on the recommendations submitted by the Town Planner in a memo dated <br /> June 5, 2023 to the ZBA Secretary as part of the decision. <br /> 2. Conditioned upon the Engineering Review Reports provided by Pesce Engineering dated <br /> June 13, 2023 and June 26, 2023 as part of this decision. <br /> 3. Prior to the request of a building permit,the applicant shall issue a working capital account <br /> in the amount of$5,000. The check shall be issued to the Town of Mashpee to be utilized <br /> to pay for the initial peer review, and for future peer review inspections and signoffs if <br /> required. <br /> 4. Conditioned on all Town Department comments read into the record, and all public <br /> comments read into the record. <br /> 5. Conditioned on the recommendations submitted by the Plan Review Committee dated <br /> Tuesday, June 6, 2023 as follows: <br /> a. The office is an allowed use as an accessory to Mashpee Neck Marina. <br /> b. Condition that the gate access and stockade fence be widened in accordance to the Fire <br /> Department recommendations. <br /> c. Conservation Department recommendations will be up to the Conservation <br /> Commission. <br /> 5 <br />
