Proposed construction and RDA <br /> <br />maintenance of attached garage, utilities, hardscaping and landscaping. Representative: <br /> <br />Cape & Islands Engineering, Inc. <br /> <br />Ms. Godfrey asked about the birch trees along the drive whether they will be removed. The <br />applicant feels the work can be done without the removal of trees but is willing to replace <br />them, if need be, but the other trees would be unaffected. Regarding a requirement of a <br />variance (vs. special permit), the applicant noted this was a new nonconforming and would <br />require ZBA approval. In response to Ms. Clapprood, Mr. McManus noted the BOH <br />comments were very standard with the condition of an additional bedroom requiring an <br />upgrade due to an increase in flow to an I/A system. Mr. Colombo was puzzled why they <br />this was an RDA not an NOI. Ms. Zollo agreed. Mr. Colombo noted the scope of work. Ms. <br />Zollo also was concerned by lack of mitigation. The applicant stressed that was removing <br />structure for structure requiring no mitigation despite being within 50 feet of the buffer. Mr. <br />McManus offered clarification that mitigation is triggered, and the applicant’s position was <br />incorrect. Regarding what constitutes an inland bank, Mr. McManus noted an 8’ break in <br />slope would cause the lower bank to be the correct delineation on the plan. Based on this <br />the applicant asked to submit a revised plan. Regarding the lawn, Mr. Kent noted that this <br />was in violation of regulation 31 fertilizer requirements. Based on this Mr. Cook echoed why <br />this an RDA as opposed to an NOI. Ms. Zollo noted and objected to the potential replanting’s <br />being within 10 feet of the foundation.
