6:12 Jeffrey M. McInnes, 17 Waterway. Proposed garage and driveway construction. NOI

Mike Ball from Marsh Matters Environmental presented plans.

Agent asked about communication between the Tax Office and the Client regarding unpaid

taxes. Typically that should be done before the hearing per Town Policy.

Mr. Sweet said the property has junk everywhere, could be leaching for all we know.

Agent inquired about extent of proposed activities and clarification of property boundaries. Mr.

Sweet said the property abuts a road layout portion of Waterway, which is not the applicant’s

property. Agent said he’d recommends a condition that prohibits any activities in the abutting

road layout area of Waterway. Agent is concerned about the proximity of proposed driveway

to the property line and recommends a condition that the lot line be staked in accordance with

the most recent surveyed plan. Project meets performance standards for coastal bank, BVW

and Land Subject to Coastal Storm Flowage. No other comments.

Assistant Agent read Building Department and Board of Health comments.

Mr. Colombo asked if the septic inspection has been done, Assistant Agent said not yet.

Mr. O’Neill asked why the driveway is so large. Mike Ball said he believes it’s to store a boat.

Mr. O’Neill said it seems like a lot of gravel so close to the property line. Agent said he had

the same concern at the site visit, it just doesn’t figure into the current regulatory language.

Agent said we can make that a condition in the motion.
Mr. Sweet motioned to close and issue with a condition that all fees and taxes be paid,
property lines be marked and staked and storm drains/dry wells be installed on the
property.
Mr. Dalton seconded the motion.
Vote: 6-0-0

Roll Call Vote:

Mr. Weeden; yes

Mr. O’Neill; yes

Mr. Sweet; yes

Mr. Colombo; yes

Mr. Dalton; yes
6:15
Ms. Zollo; yes

In favor, 6; Opposed, 0; Abstentions, 0

The Stopped Bus LLC, 161 Old Barnstable Road. I’ve met with Mashpee
Commons and their legal counsel regarding communication and compliance to
try and work out an amicable solution. They have since submitted 6 monitoring
reports that did not reveal any worsening condition of the failed culvert. Agent
said he will forward reports to the commissioners. This project should get
started around Thanksgiving and be in substantial completion by the end of the
year. Applicant asked for assurances that the concom does not pursue
additional enforcement actions. Agent assured the commission that the project
