MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />OCTOBER 11, 2023 <br />NEW HEARINGS <br />9 Woodland Avenue: Owners, Richard N. and Theresa G. Monroe request a Written Finding <br />under §174-17 of the Zoning Bylaws to allow for a deck reconstruction, a three season porch <br />addition, and extension over an existing garage to a pre-existing, non -conforming structure on <br />property located an R-5 Zoning District, Map 49 Parcel 98, Mashpee, MA. <br />The homeowners presented their application to re -construct the existing deck with a three season <br />porch. Also present was Tom Griffin, Contractor for the project. The deck was originally built at <br />an angle and does not meet their current needs. They provided the Board their site plan depicting <br />the extent of the work, and the building plans. <br />Mr. Reidy read an email dated October 11, 2023 from Catherine Laurent, DPW Director; "RE: 9 <br />Woodland Avenue. DPW is requesting that a condition of any approval be imposed requiring that <br />the property owner install drywells on their existing dwelling as well as any addition to contain <br />storm water runoff on their property. After receiving a complaint this summer from the adjacent <br />property owner (264 Hooppole Road) about flooding in his back yard, DPW investigated and <br />found evidence of storm water runoff .from 9 Woodland Ave flowing down the applicants' <br />driveways, along the backside of the road berm, and into the neighbor's backyard. Attached is a <br />photo taken last week showing the "ravine" created in one of the driveways by the storm water <br />from their roof downspout. " <br />Mr. Reidy read an email dated October 4, 2023 from Jeanne Siwik, a direct abutter who is in <br />favor of the project. <br />Mr. Ganzenmuller read the Board of Health comments dated October 6, 2023 into the record; <br />"No comment, no increase in habitable space. " Conservation Department comments into the <br />record; "No wetlands jurisdiction. " <br />Mr. Bonvie polled the Board for comments. Mr. Goldstein wanted to address the comments from <br />the DPW Director. <br />Mr. Monroe stated that he has been a resident since 1974, and every couple of years he adds plain <br />dirt on his property. He stated that the runoff is coming off Hooppole Road and travels across the <br />neighbor's property, and this is from the restructuring of the road that was done years ago. He <br />believes the road was not pitched correctly. <br />Mr. Furbush asked Mr. Monroe if he had a conversation with the DPW Director. He said; no <br />because he just received the email that morning the day of the meeting. <br />Mr. Morris suggested that a dry well could be installed with the new roof and gutters. This house <br />was built before building codes were in the State of Massachusetts. He stated that the Board can <br />certain impose further investigation on this issue. <br />2 <br />
