MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />OCTOBER 25, 2023 <br />Chairman Bonvie asked the Board if there were any comments. <br />Mr. Ganzenmuller read the Board of Health comments into the record dated October 24, 2023; <br />House is n Zone ll, to remain two (2) bedrooms. " <br />Ms. Sangeleer read the Conservation Department comments into the record dated October 18, <br />2023; "NOI permit application for raze and replace approved by Commission. " <br />Chairman Bonvie asked for comments from the Board or audience. <br />Mr. Dan Marsters a direct abutter commented that he fully supports the project. <br />Mr. Ganzenmuller made a motion to close the public comments for this application. Mr. Reidy <br />second. All were in favor. <br />The Board made a motion to accept the applicant's withdrawal of a raze and replace. Mr. Reidy, <br />so moved. Mr. Ganzenmuller second. All were in favor. <br />Mr. Reidy made a motion that the Board issue a Written Finding for 20 Bearse Road to Owners, <br />Paul K. and Kathleen A. Bettencourt under M.G.L. 40A Section 6, and under Section 174-33 <br />(Setback to wetlands) on property located in the R-3 and Popponesset Overlay Districts, Map 117, <br />Parcel 322, Mashpee, MA with the following conditions: The Board has determined that the <br />application all the conditions of a Written Finding under M.G.L. 40A Section 6 for wetlands <br />setbacks. Mr. Furbush second. All were in favor to issue a Written Finding. <br />50 Evergreen Circle: Owner, Chapter Closed LLC requests a Special Permit under § 174-25; <br />§ 174-25 (G) (14); § 174-24 (C) (2); § 174-45.6; § 174-3 7, and § 174-41 (M) of the Zoning Bylaws <br />to allow for construction of 9,672 sq. ft. contractor bay warehouse metal building on property <br />located in the I-1 and Light Industrial Overlay District, Map 19, Parcel 10-5, Mashpee, MA. <br />Sitting on this hearing are the three regular Board members, and Associate Members, Mr. Reidy, <br />and Mr. Caggiano. <br />Mr. Reidy read a letter dated October 23, 2023 from Attorney Christopher Kirrane requesting a <br />continuance until November 8, 2023 as the applicant is currently waiting for final comments from <br />Pesce Engineering, and revised plans from Cape & Islands Engineering. <br />Mr. Reidy made a motion that the Board accept the continuance for 50 Evergreen Circle until <br />November 8, 2023. Mr. Furbush second. All were in favor. <br />
