5 <br />*Monday, November 27, 2023 Charter Review Committee Minutes* <br />The next meeting will be December 11, 2023 <br />John Miller will draft the next year's meeting schedule. <br />Ortirla 7 <br />Darlene Furbush continued with review of Article 2 of the Charter. Section 3.10 needs to be <br />replace with section 3.1 (a) that defines the powers and duties of the moderator. <br />Defining who a qualified voter in section 2.1 is already covered under the definitions, no change <br />is needed. <br />Appointment of the representatives to Cape Cod Tech should be added under additional powers <br />and duties of the Town Moderator. <br />Don Myers asked why if the school committee goes through the process of being elected and <br />sends up to fifty kids to the tech school why does the committee have no say in who the <br />representatives are. <br />The agreement with Cape Cod Tech would need to be opened up and renegotiated in order to <br />allow the School Committee to be involved. <br />Cathy Lewis also said that the School Committee shouldn't be involved because it would be like <br />they were being influencing or reaching outside their district. <br />The language in section 3.6 should be left alone. <br />Section 2.3 should define which committees are established or appointed by the moderator. <br />John Miller said subject to the charter the Town Moderator only makes appointments to the <br />finance committee and Cape Cod Tech. <br />Cathy Lewis suggested changing the wording to town meeting committees or special committees. <br />The Committee flagged this for legal review. <br />John Miller suggested deleting such committees of town meeting. <br />The committee would like more clarity on this. <br />The Town Moderator should appoint the election wardens and that would fall under powers and <br />duties. The Town Clerk would be in charge of the election workers. <br />Cathy Lewis said that removing the language allowing the Town Moderator to make such <br />appointments would remove the legislative power of the public to review a committee. <br />Section 2.4 should address the potential impact of state emergencies on town meeting and <br />elections. The Committee is looking into language that would allow flexibility and flagged the <br />section for legal review. Note any dates fixed by bylaw. <br />And for the purposed of elected officers <br />
