The Board confirmed comments from Conservation. Mr. Cook <br /> stated he was not creating any new nonconformities. <br /> CONTINUED HEARINGS <br /> 33 Sunset Circle: Owners, Kevin and Suzanne C. Mulgrew, Trustees of the 33 Sunset Circle <br /> Realty Trust request a Written Finding under §174-17 of the Zoning Bylaws to allow for <br /> reconstruction and extension of an existing deck to a pre-existing, nonconforming structure on <br /> property located in an R-5 Zoning District, Map 64 Parcel 28, Mashpee, MA. (Continued from <br /> December 13, 2023, and January 10, 2024 hearings at the request of the Board). <br /> Sitting on this hearing are the five regular Board Members. <br /> Mr.Alex Lebedev represented the homeowners for the Written Finding request.At the last hearing, <br /> Mr. Lebedev submitted a revised site plan for the Board, but because the plan was submitted too <br /> late, it was not reviewed by Mr. Lehrer, Town Planner to submit his comments. The site plan <br /> required some minor revisions regarding the lot coverage of the existing conditions, and the <br /> proposed conditions of the (BVW) Bordering Vegetated Wetlands calculations for the setback to <br /> wetlands. <br /> Mr. Reidy read the Board of Health comments dated January 22, 2024 into the record; "No <br /> habitable space, no comments", and the Conservation Department comments dated January 23, <br /> 2024; "This project was issued an order of conditions by the Conservation Commission. They <br /> approved this project as they felt it met the performance standards for the applicable <br /> wetlands/wetland resource areas on site, including inland bank (resource area) and bordering <br /> vegetated wetland (wetland). The mitigation proposed (compensatory plantings) will provide an <br /> enhanced naturally vegetated buffer area to the pond. " <br /> Mr. Reidy read the Town Planner's comments dated January 18, 2024 into the record; "This <br /> revision satisfies my concern. The plan accurately reflects the lot's area as required by the zoning <br /> bylaw. This revision shows the total amount of Bordering Vegetated Wetland on the subject parcel <br /> totaling 2,499 sq. ft. The plan subtracts that area from the total lot area including upland and <br /> wetland. Lot coverage is then accurately calculated in both the existing conditions plan and the <br /> proposed improvements: <br /> 3 <br />
