MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 14,2024 <br /> Mr. Reidy read a letter from the Building Department dated February 6, 2024; "Owners realized <br /> mistake after the fact. " The Board of Health comments dated February 8, 2024: "Not a habitable <br /> space, no increase in septic flow. Septic is on other side of house. " <br /> Mr. Reidy read the comments from the Town Planner dated January 5, 2024 into the record. <br /> Ms. Sangeleer read the direct abutter letter into the record dated November 1, 2022, and have no <br /> objections to the placement of the shed. <br /> The Board had a brief discussion regarding the outcome of the last hearing, and determined that <br /> the homeowners had complied with their request to move the smaller shed. <br /> Mr. Funk explained to the Board that the shed was built at the same time as the pool, and the pool <br /> equipment wiring is connected to the shed. Also, if the shed were moved closer to the pool there <br /> would be less access and would require the homeowners to redesign,and reconstruct the pool area, <br /> etc. <br /> Mr. Furbush believes that is a hardship. Mr. Goldstein was concerned about setting a precedence <br /> for future applicants. Mr. Blaisdell stated that every case stands on its own. <br /> Chairman Bonvie explained that the homeowners have complied with the Board. <br /> Mr. Reidy asked for an explanation noted in the Town Planner's comments stating is "an <br /> unprotected nonconforming use". Attorney Kirrane explained that the Board could not grant any <br /> future applications such as a Written Finding if the homeowners wanted to expand the shed or the <br /> house with the approved setback. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Blaisdell made a motion to close <br /> the public hearing. Mr. Furbush, second. All were in favor. <br /> Mr. Bonvie asked for a motion of the hearing. <br /> Mr. Reidy made a motion for Owners, Christopher P. Funk and Donna M. Funk requesting a <br /> Variance under §174-31 of the Zoning Bylaws to allow for construction of a 200 sq. ft. shed on <br /> property located in an R-5 Zoning District, Map 29, Parcel 150, Mashpee, MA with the following <br /> conditions: <br /> 1. Site Plan: Prepared for Christopher & Donna Funk, Project: 5 Sheffield Place, Mashpee, <br /> MA. Sheet 1 of 1, Scale: 1" = 20', Date: August 2, 2023, Drawn by: JJF, Checked by: <br /> MCC,Prepared by: Cape &Islands Engineering,Drawing Title: Existing Conditions Plan. <br /> Stamped and signed by: Matthew C. Costa,No.: 52282. <br /> 2. Conditioned on the comments submitted by the Town Planner. <br /> 2 <br />
