MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner, Brendon P. Giblin <br /> 90 Popponesset Island Road, Map 106, Parcel 34 <br /> Mashpee, MA 02649 <br /> SP-2023-67 <br /> • The proposed dwelling is consistent with redevelopment in the neighborhood. <br /> • The overall structure coverage is less than 20%. <br /> • The Board determined that the proposed project will comply with the Special Permit <br /> requirements under §174-24 C (2) of the Zoning Bylaws. <br /> • The Bylaw requires two parking spaces for a residential structure. There will be sufficient <br /> parking with the construction of the proposed garage, and setbacks as may be required. <br /> • Construction of the dwelling is contingent upon Board of Health final approval. <br /> • The Conservation Department will oversee the project's proposed extensive mitigation, <br /> and requires pervious pavers. <br /> • The Building Commissioner will oversee the construction of the new dwelling as required. <br /> The Board finds that no new non-conformities will be created by this project. <br /> In view of the foregoing,the Board determined the Petitioner met the criteria for a Special Permit. <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, January 24, 2024, <br /> the Zoning Board of Appeals voted unanimously to issue Owner, Brendon P. Giblin a Special <br /> Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing,nonconforming <br /> residential structure, and replace it with a new single family residential structure with associated <br /> pool and detached garage with guest suite above on property located in an R-3 Zoning District, <br /> Map 106 Parcel 34, Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2.
