Discussions focused around whether or not public access easements could be created <br /> during a building or like project taking place within the areas of wetlands jurisdiction or <br /> Ch. 91. From initial conversations with Ch.91, they believed this would require the <br /> Town's Zoning Board of Appeals and approval of a change in the Town's zoning <br /> regulations. Mr. Lehrer has never seen an easement created on a single family non- <br /> conforming lot, but this is a topic that could be brought up when he is in discussion with <br /> the Planning Board to draft regulatory changes around the Town's Raise and Replace <br /> Bylaw. He admitted this may be a difficult task that needs to be evaluated more at a <br /> legal level. For special permits, the planning board may be able to condition for the <br /> creation of a public access point,but this would be specific to the property and may <br /> require a Town taking. Ultimately the town should identify these parcels and work with <br /> the property owner to negotiate a taking or transfer for the creation of a public access <br /> point. <br /> Dick Cook and Dick Noonan asked if these parcels will be identified through the <br /> planning process, and whether the Town owned some portion of the roadway to create <br /> an area for parking as parking is always an issue in these locations. Mr. Lehrer <br /> explained that it depends on the layout of the road, and whether the road is private <br /> versus public. In short the road layout depends on the area in question and those areas <br /> would need to be identified. Mrs. Fisher also brought up that some properties were <br /> gifted to the town for a specific use, and those use restriction need to be taken into <br /> consideration. <br /> • Discussion of Look and Feel of the Plan: <br /> LCP Update from the Town Planner <br /> Mr. Lehrer will be supplying draft sections of the Local Comprehensive Plan to UHT to <br /> make sure the look and feel of the plan remains consistent to other plans in draft form. <br /> The release of the LCP is delayed in its release, but the implementation sections and <br /> table along with some chapters are available for review. <br /> • Review of Draft Sections : <br /> UHI update to the Committee <br /> The Harbor Mangment Plan draft sections are coing along. Some sections are ready for <br /> review, but UHI wanted to ask the group if the review process should begin with only <br /> some sections or if we wanted to wait for the plan to be draftied in its entirety. Mrs. <br /> Uiterwyk also mentioned that the draft sections will not be ready until she has had <br /> enough engagement with the Mashpee Wampanoag Tribe. The schedule "Lunch and <br /> Learn"with tribal elders may be enough engagement to wrap up some sections. Mr. <br /> Oakley agreed that heating from tribal elders at that event should be enough to complete <br /> some sections. He also mentioned that other tribal members we were previously <br /> interested in interviewing will be in attendance for that event. Ultimately, the <br /> committee chose to wait to the review the draft sections until all sections have been <br /> drafted. <br /> NEW BUSINESS <br />
