MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MAY 22, 2024 <br /> Mr. Bonvie asked for comments from the audience. There were none. <br /> Mr. Bonvie, Chair reviewed the zoning aspects; there are no new non-conformities being created. <br /> There are some conformities being reduced or eliminated. <br /> Mr. Bonvie asked for a motion to close the public hearing. Ms. Sangeleer, so moved. Mr.Furbush, <br /> second. All were in favor to close the public hearing. <br /> Mr. Ganzenmuller made a motion that the Board issue a Special Permit to Petitioners, Patrick and <br /> Julie McNamara for 70 Alma Road under §174-17.1 and §174-33 of the Zoning Bylaws to raze a <br /> pre-existing, nonconforming single-family structure and replace it with a new single-family <br /> structure on property located in an R-3 Zoning District and the Popponesset Overlay District, Map <br /> 117 Parcel 161, Mashpee, MA. (Owner of record: Harry F. Selewacz and Marilyn T. Selewacz <br /> Irrevocable Family Trust) with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan—Prepared for: Patrick and Julie McNamara, Project: 70 Alma Road, Mashpee, <br /> MA. Sheet No.: 1 of 1, Date: March 28, 2024, Prepared by: Cape & Islands Engineering, <br /> Stamped and signed by: Mark Dibb, and Matthew C. Costa. <br /> 3. Building Plans — McNamara Residence, 70 Alma Rd. Sheet No.: 1 - First Floor Plan, <br /> Second Floor Plan, Sheet No. 2: Front Elevation, Right Elevation. Sheet No. 3: Rear <br /> Elevation, Left Side Elevation. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Board of Health and Conservation Department comments. <br /> 5. Any changes to the plans will require the applicant to return to this Board. <br /> 6. Conditioned that the applicant seek and obtain the Town Planner's review in reference to <br /> the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building <br /> permit. <br /> 7. The Board finds under §174-17.1 and§174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing,nonconforming structure or use to either the Town <br /> or the neighborhood,that there is sufficient parking, and there are no new non-conformities <br /> being created. <br /> 3 <br />
