The
ruling was a negative determination. However, the property’s new owners are now requesting a
pier. Mr. Kent mentions that several months prior, Cape & Islands Engineering, Inc. submitted a
draft for the dwelling, indicating that a pier draft should be expected later. He emphasizes that
the Commission should keep in mind that the site for the pier has been previously disturbed.

Mr. Cook seeks clarification regarding the disturbed area and inquires about plans for
replanting. Mr. Kent assures him that replanting will indeed take place, and there is a mitigation
plan attached to the previous, RDA. However, this plan has not yet been completed due to
ongoing construction.

There are no public comments.

Motion made by Mr. Cook to close and issue with the condition that any
conditions from Natural Heritage be incorporated into the order of conditions.
