The order was extended
to September 2024. The property is adjacent to a licensed existing stone seawall, with a salt
marsh band and an isolated vegetated wetland on the east side of the lot.
The existing stone seawall is deteriorating and showing signs of settlement, so the proposed
solution is to build a vertical bulkhead next to the seawall. Mr. Borselli provided details about
the construction and materials to be used for the project, emphasizing the importance of the
chosen method, which avoids excavation and removal of stonework from the site.
The Department of Environmental Protection (DEP)recognizes the proposed vertical wall as a
licensed structure and considers it maintenance under the existing Chapter 91 license.
The representative states that there have been discussions with the agent about the means and
methods, and they are willing to speak with a contractor for additional options. They are also
open to suggestions or concerns from the commissioners.
The agent's concerns have been explained, and methods intended to minimize disturbance have
been discussed, including conversations with wetland restoration professionals.
The Division of Marine Fisheries has suggested that the cove is a habitat for softshell clams. The
Shellfish Warden has stated that no shellfish mitigation is necessary.
COMMISSIONERS COMMENTS
• Q: The proposed fill between the rocks and proposed bulkhead, what will be the plantings
there?
o A: There will be salt marsh planting.
• Q: Would the "squishy" sections be considered a salt marsh if not mowed?
o A: Mr. Borselli ensures a site walkthrough with a professional will be completed,
and alternative options will be discussed.
• The Commissioner states the concerns for access to the upland are extremely valid within
the saltmarsh resource area. There is a suggestion to use the opportunity to restore the
10
