There are no public comments. <br /> AGENT COMMENTS <br /> The proposed extension meets the design standards for Docks/Piers under Regulation 27. The <br /> Harbor Master has no navigational concerns, and the Shellfish Constable has no objections. The <br /> property owner is currently complying with an enforcement order to mitigate illegally cut trees <br /> on the inland bank. Mitigation plantings have been installed and inspected, but the owner still <br /> needs to submit a signed contract for monitoring and maintenance with a qualified professional. <br /> The owner has been informed that this contract must be submitted before the permit hearing can <br /> be opened and deliberated upon by the Commission. The agent will provide an update on this <br /> status to the ConCom prior to the opening of the hearing. <br /> • If the applicant has submitted the signed mitigation monitoring contract before this <br /> hearing, the recommendation is to close and issue subject to the following conditions: <br /> 1) Any requirements from Natural Heritage should be included in the local order <br /> of conditions <br /> 2) Storing seasonal dock components, boats, kayaks, or any related materials on <br /> the inland bank or over any existing vegetation within wetlands jurisdiction <br /> during the off season is not allowed <br /> 3) The dock grating must allow at least 50% sunlight penetration to the <br /> subsurface below <br /> - The agent states there is currently a boat and dock sections on the bank that need to be <br /> removed immediately. <br /> ➢ Board of Health: Note the location of the septic system and restrict equipment/vehicle <br /> traffic over non-load bearing (H-10) components. <br /> ➢ Building: No jurisdiction. <br /> ➢ Shellfish: This project will not warrant a shellfish mitigation fee. <br /> Motion made by Mr. Cook to close and issue with the conditions recommended by the Agent. <br /> Motion seconded by Ms. Zollo.No further discussion. <br /> Clarification from the Chairman is requested as to whether or not the order of conditions is <br /> withheld from issuance until Natural Heritage has come back with a response. The Agent states <br /> there is a 21 day issuance requirement. A condition can be added to the order of conditions to <br /> incorporate any requirements from Natural Heritage. <br /> • ROLL CALL: Ms. Zollo (Yes), Mr. Cook(Yes), Ms. Clapprood (Yes), <br /> Ms. Godfrey (Yes), Mr. Colombo (Yes). <br /> The motion passes unanimously. <br /> Documents provided: Cape & Islands Engineering, Inc.
