Lastly, a motion was <br /> made and seconded to accept a remand on the denial of an Order of Conditions <br /> without prejudice with no further discussion. <br /> o ROLL CALL: Ms. Zollo (Yes), Mr. Cook(Yes), Ms. Clapprood (Yes), Ms. <br /> Godfrey (Yes), Mr. Colombo (Yes). <br /> The motion passes unanimously. <br /> ❖ The Agent will update the applicant and will update the Commission accordingly. <br /> ❖ The Agent leaves the meeting at approximately 10 pm. <br /> • Regulation 25 (LSCSF) - discussion on draft performance standards <br /> o Motion made by Mr. Cook to discuss and vote at a later date. Motion seconded <br /> by Ms. Clapprood. <br /> ❖ The vote to table the item was not called by the Chairman. <br /> The Chairman provided an update to the public, indicating that the focus of the discussion <br /> tonight is to begin with performance standard 1. If accepted, the subcommittee will proceed to <br /> the next standard, and so on. Once all standards are accepted, Regulation 25 will be drafted for <br /> legal counsel review. If approved, the draft will be open for public review and hearing. The <br /> Commission will review public comments and make revisions to the draft as necessary. <br /> Following legal counsel review and public comment the Commission will hold another public <br /> hearing for promulgation. Draft 3 was presented to the public on May 2nd, 2024, at the quarterly <br /> meeting. <br /> PUBLIC COMMENT <br /> During the meeting, John Malloy from the Popponesset Beach Association (PBA)informed the <br /> Commission that they will have a professional engineer review the proposed Regulation 25 draft <br /> (3). They will update the Commission with their recommendations once the review is complete. <br /> Mr. Cook mentioned that a meeting with Mr. Malloy and the members of the Popponesset Beach <br /> Association is scheduled for June 24, 2024, at 8 am to discuss the community's concerns. <br /> The Commission acknowledged the concerns raised by the PBA. However, due to the significant <br /> impact on the wetlands and coastal areas, the town intends to clarify the confusion between the <br /> current language in the regulation and make it align more closely with DEP guidelines. <br /> It was also stated that policy/regulation memos or small working group memos are exempt from <br /> public record. The Commission members should receive the policy drafts before they are made <br /> public. Mr. Malloy expressed concerns about the lack of transparency between PBA, the <br /> Commission, and other members of the public. He mentioned that PBA did not receive a copy of <br /> the 3rd draft for Regulation 25 like other members of the public did. <br /> The Commission clarified that the public regulation draft was made available on May 2nd, 2024, <br /> during the quarterly meeting. PBA had the right to request a copy of the draft anytime after May <br /> 2nd. Furthermore, the drafts are not sent out individually to the public; a request for a copy is <br /> required. <br /> 3 <br />
