MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Robert P. McDonald, Jr. and Tracy A. McDonald <br /> 14 Capstan Circle, Map 111, Parcel 101 <br /> Mashpee, MA 02649 <br /> SP-2024-09 <br /> SPECIAL PERMIT FINDINGS <br /> The Board finds and determined that the proposed raze and rebuild proposal will not be <br /> substantially more detrimental to the neighborhood than the existing structure and use for the <br /> following reasons: <br /> • The new structure will be building code compliant. <br /> • The new construction will comply with flood zone requirements. <br /> • There are no new non-conformities being created. <br /> • A new I/A septic system is proposed. <br /> • The Conservation Commission has approved the project. <br /> • Drywells will be installed. <br /> • There is no increase in the number of bedrooms. <br /> • The total lot coverage of structures is 19.9% (under 20%maximum). <br /> The Board further determined the Petitioner met the criteria for a Special Permit. Upon motion <br /> duly made and seconded at the Public Hearings on Wednesday, May 22, 2024 the Zoning Board <br /> of Appeals voted 4-0 to issue a Special Permit to Owners, Robert P. McDonald, Jr. and Tracy A. <br /> McDonald under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing, <br /> nonconforming three bedroom single-family dwelling, and replace it with a new three bedroom <br /> single-family dwelling on property located in an R-3 Zoning District, at 14 Capstan Circle, Map <br /> 111, Parcel 101, Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan — Prepared for: Robert P. and Tracy A. McDonald, Project: 14 Capstan Circle, <br /> Mashpee, MA.
